Abstract This paper has the purpose to investigate how constitutionalism has been used abusively to cover decisions of the Brazilian Supreme Court with ideological motivations or that favor certain political actors, which is called the completion of judgments. To reach its scope, the research develops based on a critical-methodological line and from a methodology of historical-legal investigation, starting from the theoretical framework of abusive constitutionalism, based on cases judged by the Court from 2013 to 2018. In the end, it is concluded that, in several situations, constitutional law was used by the Supreme Court only to justify or give legitimacy to decisions, which have an eminently political nature, as well as that the completion of judgments could undermine the democratic reason for judicial action in matters of politics and erode the expectation that the Supreme Court is the guardian of constitutional order, the rule of law and democracy.

Resumo O presente artigo tem o objetivo de investigar se o constitucionalismo tem sido utilizado abusivamente para encobrir decisões do Supremo Tribunal Federal com motivações ideológicas ou que favorecem determinados atores políticos, o que se denomina de fulanização de julgamentos. Para atingir seu escopo, a pesquisa se desenvolve com base em uma linha crítico-metodológica e a partir de uma metodologia de investigação histórico-jurídica, a partir do marco teórico do constitucionalismo abusivo, com base em casos julgados pela Corte no período de 2013 a 2018. Ao final, conclui-se que, em diversas situações, o direito constitucional foi utilizado pelo Supremo Tribunal Federal apenas para justificar ou dar aparência de legitimidade a decisões, que, em verdade, possuem natureza eminentemente política, bem como que a fulanização de julgamentos pode minar a própria razão democrática da atuação judicial em matéria de política e corroer a expectativa de que a Corte Constitucional brasileira seja a guardiã da ordem constitucional, do Estado de Direito e da democracia.

Abstract The digitization of judicial processes and the modernization of court systems have propelled the use of artificial intelligence in the Judiciary, particularly due to the backlog of cases in higher courts. Project Victor, led by the Supreme Federal Court (STF) in collaboration with the University of Brasília, aims to automate the categorization of Extraordinary Appeals based on themes of General Relevance. However, implementing AI in the public sector requires adherence to constitutional principles such as legality, impartiality, morality, transparency, and efficiency. The study addresses the conflict between efficiency and legality principles regarding the use of the Victor program. Research encompasses the history and types of AI, machine learning methods, and analysis of AI software in Brazilian courts. Results highlight Victor’s efficiency while noting issues like inadequate decision summaries. The conclusion underscores the need for transparency in AI use and suggests adding case notes to electronic processes indicating Victor’s intervention for potential revisions.

Resumo A digitalização dos processos judiciais e a modernização dos sistemas dos tribunais impulsionaram o uso de inteligência artificial no Poder Judiciário, especialmente devido à sobrecarga de processos nas cortes superiores. O projeto Victor, liderado pelo STF e em colaboração com a Universidade de Brasília, busca automatizar a separação de Recursos Extraordinários por Tema de Repercussão Geral. No entanto, a aplicação da IA no setor público requer consideração dos princípios da legalidade, impessoalidade, moralidade, publicidade e eficiência estabelecidos na Constituição. O estudo aborda o conflito entre os princípios da eficiência e da legalidade em relação ao uso do programa Victor. A pesquisa incluiu histórico e tipos de IA, métodos de aprendizado de máquina e análise de softwares de IA em tribunais brasileiros. Os resultados destacam a eficiência do programa Victor, embora ressaltem problemas como resumos inadequados de decisões. A conclusão enfatiza a necessidade de transparência perante o uso de IA, propondo a adição de movimentações nos processos eletrônicos para indicar intervenção do Victor, permitindo revisões quando necessário.

Abstract The article employs comparative analysis to investigate the nexus between constitutional adjudication and electoral systems through the perspective of the principle of equality in elections. It delves into the different reasoning of the constitutional courts of Germany, Italy and Spain, trying to unpack the various interpretations attached to that principle under the case law of these courts. In particular, it explores the arguments revolving around the interpretation of equality as the “one person, one vote” rule and its potential wider meaning, comparing the approaches adopted in the case law of the three jurisdictions. On a theoretical level, this submission aims to provide insights on the functions and limits of constitutional review in electoral matters and, more generally, to contribute to studies of constitutional law concerned with the tension between legislative discretion and the role of constitutional courts.

Resumo Este estudo aborda, de forma comparativa, o nexo entre a jurisdição constitucional e os sistemas eleitorais através da perspectiva do princípio da igualdade em matéria eleitoral. Desta maneira, o seu objetivo é examinar as linhas de argumentação dos tribunais constitucionais da Alemanha, Itália e Espanha, tentando desdobrar as diferentes interpretações desse princípio sob a jurisprudência dos países mencionados. Em particular, explora os argumentos que giram em torno da interpretação da igualdade como a regra de “uma pessoa, um voto” e seu potencial significado mais amplo, comparando as abordagens adotadas na jurisprudência das três jurisdições acima citadas. Em um nível teórico, o artigo tenta também realçar as funções e limites da revisão constitucional em matéria eleitoral e, mais em geral, contribuir para estimular os estudos de direito constitucional focados em a tensão entre a discricionariedade legislativa e o papel dos tribunais constitucionais.

Abstract This paper exploring the Freedom of Speech in Canadian Constitutional Law is part of the series “Constitutional Law Around the Globe”. This chapter of the series focuses on “Fundamental Rights and Freedom of Speech” in contemporary democracies. Second in the row, this paper analyses the Freedom of Speech in Canadian Constitutional Law and how it has been shaped by the Supreme and lower courts over time, specially on the so-called “hate speech”. A final paper will approach the legal systems composing the series in a comparative perspective.

Resumo Este artigo, analisando a Liberdade de Expressão no Direito Constitucional Canadense, faz parte da série “Direito Constitucional ao Redor do Globo”. Esta parte da série tem por foco “Direitos Fundamentais e a Liberdade de Expressão” em democracias da atualidade. Segundo da série, este artigo analisa a Liberdade de Expressão no Direito Constitucional Canadense e como ela tem sido delineada pela Suprema Corte e tribunais inferiores ao longo do tempo, especialmente no que diz respeito ao denominado “discurso de ódio”. Um artigo final abordará os sistemas jurídicos componentes da série em uma perspectiva comparada.

Abstract This paper seeks to analyze measures that restructure courts, especially the Brazilian Supreme Federal Court, to verify the compatibility of such changes with the principle of separation of powers. This proposal draws its importance from the study of legislative changes that, at first glance, seem legitimate, but when analyzed contextually, reveal marks of deep unconstitutionality due to violation of the distribution of powers and the system of checks and balances. A comparative law study was then carried out to see how this process has happened in other countries that are or have been democracies (USA, Venezuela, Hungary, and Poland). From this analysis, and using an inductive argument, a concept was developed for the phenomenon here called “court taming”, as well as a typology that allows an objective analysis of cases. Armed with this tool, four potentially characterizing situations of “domestication” were investigated in the national territory. In the final sections, it was demonstrated that the events that occurred in Brazil are cases of court taming, representing a violation of the separation of powers and therefore being unconstitutional. An interpretation was also presented that can prevent the occurrence of the taming phenomenon.

Resumo O presente trabalho busca analisar medidas de reestruturação de tribunais, em especial do Supremo Tribunal Federal, para verificar a compatibilidade de tais alterações com o princípio da separação de poderes. A proposta tem sua importância ligada ao estudo de alterações legislativas que, a priori, parecem legítimas, porém, quando analisadas contextualmente, revelam marcas de profunda inconstitucionalidade por violação à distribuição de poderes e ao sistema de freios e contrapesos. Realizou-se, então, um estudo de direito comparado para verificar como esse processo tem acontecido em outros países que são ou que foram democracia (EUA, Venezuela, Hungria e Polônia). A partir dessa análise, e utilizando um argumento indutivo, desenvolveu-se um conceito para o fenômeno aqui denominado de “domesticação de cortes”, bem como uma tipologia que permite uma análise objetiva dos casos. Munido de tal instrumento, investigou-se, em território nacional, quatro situações potencialmente caracterizadoras de “domesticação”. Nas seções finais, demonstrou-se que os eventos ocorridos no Brasil são casos de domesticação de cortes, representando uma violação à separação de poderes e sendo, portanto, inconstitucionais. Apresentou-se, ainda, uma interpretação apta a obstar a ocorrência do fenômeno da domesticação.

Abstract Fiscal control is an essential tool for the fight against corruption and the improvement of public entities through technical and quality audits. Therefore, the proper election of the comptroller general of the Republic is fundamental to guarantee the objectivity and quality of the fiscal control of the State. In Colombia, since the Comptroller’s Office was created in 1923, the political influence and friendship in the election of the comptrollers have been criticized, as well as their lack of suitability. In this sense, a good part of the deficiencies of fiscal control in Colombia are due to the lack of objective rules in the election of the comptroller general and the undue political influence that Congress has. The election for Comptroller General 2022-2026 had so many irregularities that it forced the Council of State last May 2023 to annul the election of the comptroller and order the Congress of the Republic to redo the entire process. This article seeks to analyze the difficulties of the election of the comptroller general in Colombia.

Resumen El control fiscal es una herramienta esencial para la lucha contra la corrupción y la mejora de las entidades públicas mediante auditorías técnicas y de calidad. Por ello, la adecuada elección del contralor general de la República es fundamental para garantizar la objetividad y calidad del control fiscal del Estado. En Colombia, desde que fue creada la Contraloría en 1923, se criticó la influencia política y la amistad en la elección de los contralores, así como su falta de idoneidad. En este sentido, buena parte de las deficiencias del control fiscal en Colombia se deben a la falta de reglas objetivas en la elección del contralor general y la indebida influencia política que el Congreso. La elección para Contralor General 2022-2026 tuvo tantas irregularidades, que obligó al Consejo de Estado el pasado mes de mayo de 2023, a anular la elección del contralor y ordenar al Congreso de la República a rehacer todo el proceso. El presente artículo busca analizar las dificultades de la elección del contralor general en Colombia.

Abstract This article sets out the minimum conditions that the institutional design of citizen participation should contain, so that it can be considered good, and that, as a constitutional democratic principle, it can be specified. All this, from the Theory of public choice, and within the context of Colombian Constitutional Law. It is concluded that said design must not only have internal and external coherence, and contain the characteristic aspects of the democratic principle; rather, it must limit behaviors to prevent public decision makers from favoring their own interests instead of the general ones.

Resumen Este artículo plantea las condiciones mínimas que debería contener el diseño institucional de la participación ciudadana, para que pueda ser considerado bueno, y que, como principio democrático constitucional, se pueda concretar. Todo ello, desde la Teoría de la elección pública, y dentro del contexto del Derecho Constitucional colombiano. Se concluye que dicho diseño, no solo debe tener coherencia interna y externa, y contener los aspectos característicos del principio democrático; sino que debe limitar los comportamientos para evitar que los tomadores de decisiones públicas favorezcan sus propios intereses en lugar de los generales.

Abstract With the emergence of transformative Latin American constitutionalism, it is necessary to review the metaphors that serve as its foundation and that prescribe its proper functioning. To do this, it is proposed to assimilate these constitutions to a master plan aimed at social change. This analogy has important implications from recent developments in ontology and social philosophy. For the branches of the State as agents linked to the development of the constitutional project, this implies the maxims of mutual responsiveness, commitment to the joint activity and commitment to mutual support. The latter is where the analytical foundation of the duty of collaboration between the public powers to comply with the constitutional plan lies. In addition to this, a significant number of Latin American constitutions expressly provide that mandate, together with devices that develop it and practices such as structural sentences that use it as a foundation. Therefore, addressing the meaning and scope of the principle of harmonious collaboration between powers is not only novel, but also promising in order to improve the effectiveness and compliance of constitutional texts with a transformative vocation.

Resumen Con la aparición del constitucionalismo transformador latinoamericano se hace necesario revisar las metáforas que le sirven de fundamento y que prescriben su debido funcionamiento. Para ello, se propone asimilar estas constituciones a un plan maestro orientado al cambio social. Esta analogía trae importantes implicaciones a partir de los recientes desarrollos de la ontología y la filosofía social. Para los órganos y ramas del Estado, como agentes vinculados al desarrollo del proyecto constitucional, les implica el cumplimiento de las máximas de mutua receptividad, compromiso con la actividad compartida y de apoyo mutuo. En esta última es donde radica el fundamento analítico del deber de colaboración entre los poderes públicos para el cumplimiento del plan constitucional. Adicional a ello, un número significativo de constituciones latinoamericanas prevén expresamente dicho mandato, junto con algunos dispositivos que lo desarrollan y prácticas como las sentencias estructurales que lo usan de fundamento. Por lo tanto, abordar el significado y alcance del principio de colaboración armónica entre poderes resulta no solo novedoso, sino prometedor de cara a mejorar la eficacia y cumplimiento de los textos constitucionales con vocación transformadora.

Abstract In times of global crisis caused by terrorism, migration, climate change, and the pandemic caused by Covid-19, it is necessary to reflect on the norms and measures adopted by the different States to face the crisis, which, on repeated occasions, have jeopardized the fundamental pillars of democracy. In this sense, the purpose of this article is to carry out a comparative analysis of the Law of Exceptionality in Colombia and Mexico, highlighting not only the differences existing in both legal models about regulation, the system of controls and the suspension of rights according to the constitutional order in force but also highlighting how the Executive Branch avoids the use of these mechanisms by using the statutory law of Exceptionality to circumvent the system of limits, controls, and guarantees established in the Law of exception, as has occurred during the pandemic, where both countries restricted citizens’ rights and freedoms using ordinary norms, which shows an excessive abuse of the ordinary Law of exceptionality by the governments of these countries, with the consequent breach of the democratic order and the social rule of law.

Resumen En tiempos de crisis global causadas por el terrorismo, la migración, el cambio climático y la pandemia causada por el Covid-19, es necesario reflexionar sobre las normas y las medidas adoptadas por los distintos Estados para enfrentar la crisis. En reiteradas ocasiones, estas acciones ponen en jaque los pilares fundamentales de la democracia. La finalidad de este artículo es realizar un análisis comparativo del Derecho de excepcionalidad en Colombia y México. Esto permitirá no solo resaltar las diferencias en ambos modelos jurídicos en términos de regulación, sistema de controles y suspensión de derechos según el orden constitucional vigente, sino también destacar cómo el Poder Ejecutivo utiliza el Derecho de excepcionalidad ordinario para eludir el sistema de límites, controles y garantías establecido en el Derecho de excepción, lo que conlleva el quebrantamiento del orden democrático y del Estado social de derecho. Este análisis arroja luces sobre la necesidad de repensar las prácticas gubernamentales y garantizar que las acciones de emergencia se ajusten a los principios democráticos y al Estado de derecho, protegiendo así los derechos fundamentales de los ciudadanos.

Abstract This paper presents a synthesis of critical analyses about the lack of transparency and the problem of biases in the use of artificial intelligence (AI) systems as support or for effective judicial decision making from the Brazilian context, based on researches coordinated by the authors. From the methodological point of view, bibliographic, documentary and empirical researches were developed in the investigations. Analytical-interpretative studies of the materials gathered were made in order to ground the considerations. In the approach, a brief description of the state of the art regarding the use of AI by the national judiciary was elaborated, followed by analyzes on the opacity of algorithms and cognitive biases, according to topics related to the structural incompatibility between data processing by AI and the application of Law; the inability of the AI to make value judgments; the accentuation of cognitive biases by AI; and lack of transparency in relation to the algorithms and data used by the AI. At the end, proposals are presented to face the problems related to the use of AI for judicial decision making.

Resumo Neste artigo, é apresentada a síntese de análises críticas realizadas em pesquisas coordenadas pela autora e pelo autor sobre a falta de transparência e o problema dos vieses no uso de sistemas de inteligência artificial (IA) como apoio ou para a efetiva tomada de decisão judicial, a partir do contexto brasileiro. Do ponto de vista metodológico, foram desenvolvidas pesquisas bibliográficas, documentais e empíricas nas investigações. Foram feitos exames analítico-interpretativos acerca dos materiais levantados para alicerçar as considerações. Na abordagem, foi elaborada uma breve descrição acerca do estado da arte quanto ao uso de IA pelo Judiciário nacional, seguida pelas análises sobre a opacidade dos algoritmos e os vieses cognitivos, conforme os tópicos relacionados com a incompatibilidade estrutural entre o processamento de dados pela IA e a aplicação do Direito; a incapacidade da IA realizar juízos de valor; a acentuação dos vieses cognitivos pela IA; e a falta de transparência em relação aos algoritmos e aos dados utilizados pela IA. Ao final, são apresentadas propostas para enfrentamento dos problemas com o uso de IA para a tomada de decisão judicial.

Abstract The present study aims at analyzing the foundations used by the Federal Supreme Court (STF) in judging the claim of non-compliance with a fundamental percept 738/DF (ADPF 738/DF) to decide on the impossibility of recognizing quotas for black applications in politics for equivalence to the gender quotas in politics. Considering that in the ADPF 738/DF the STF recognized the main responsibility of the National Congress for stipulating the affirmative actions directed to the promotion of a higher inclusion of the black population in politics, and, given that this majority that forms the current scenario of the National Congress - formed, mainly, by non-black representatives (currently, the black population represents 22,22% of the Federal Senate and 24,16% of the House of the Representatives) - has not demonstrated commitment in articulating affirmative actions in this sense, the study intends to highlight the constitutional jurisdiction acting on behalf of correcting the democratic representation deficits in an inclusive and egalitarian perspective, precisely by the fact of remaining exclusively to the burden of the politics majority the responsibility for the articulations of affirmative actions to stimulate applications of the black population for political positions. To do so, the deductive approach method and the analytical procedure method will be used. From the analysis, it was concluded that, in the ADPF 738/DF, the inexistence of a legal provision defining the affirmative action of reserve of positions for black people applications in the political parties was the main foundation for recognizing the impossibility of equivalence to the gender quotas in politics, restated in the decision of the ADI 5617/DF. Concerning the protection of politically sub-represented minorities, it was observed that not only the counter-majoritarian acting functions as a mechanism of minorities protection by means of the constitutional jurisdiction acting, but also the articulation of strategic litigations may act as an important actor of meaningful social changes, claiming that the constitutional jurisdiction utter structural decisions directed to meet the democratic deficits and may correct the situations of structural inequality.

Resumo O presente estudo tem como objetivo analisar os fundamentos utilizados pelo STF no julgamento da Arguição de Descumprimento de Preceito Fundamental 738/DF para decidir pela impossibilidade de reconhecimento das cotas de candidatura para negros na política por equiparação às cotas de gênero na política. Levando-se em consideração que na ADPF 738/DF o STF reconheceu a responsabilidade prioritária do Congresso Nacional para a estipulação de ações afirmativas direcionadas à promoção de uma maior inclusão da população negra na política e, diante do fato de que essa maioria que compõe a atual conjuntura do Congresso Nacional — composta, majoritariamente, por representantes não negros (atualmente, a população negra representa 22,22% da composição do Senado Federal e 24,16% da Câmara de Deputados) — não tem demonstrado empenho na articulação de ações afirmativas nesse sentido, o estudo pretende destacar a atuação da jurisdição constitucional em prol da correção dos défices de representação democrática numa perspectiva inclusiva e igualitária, justamente pelo fato de permanecer exclusivamente ao encargo da maioria política a responsabilidade pela articulação de ações afirmativas de estímulo à candidatura da população negra a cargos políticos. Para tanto, utilizar-se-á o método de abordagem dedutivo e o método de procedimento analítico. Da análise, concluiu-se que, na ADPF 738/DF, a inexistência de previsão legal definindo a ação afirmativa de reserva de vagas para candidatura de pessoas negras nos pleitos eleitorais foi o principal fundamento para o reconhecimento da impossibilidade de equiparação com as cotas de gênero na política, reafirmadas na decisão da ADI 5617/DF. No tocante à proteção das minorias politicamente sub-representadas, se constatou que não só a atuação contramajoritária opera como um mecanismo de proteção das minorias por intermédio da atuação da jurisdição constitucional, assim como a articulação de litígios estratégicos pode atuar como importante ator de mudanças sociais significativas, reivindicando que a jurisdição constitucional profira decisões estruturantes direcionadas a suprir os défices democráticos e possa corrigir as situações de desigualdade estrutural.

Abstract This research analyzes the importance of the freedom of expression in the creation of the metaverse, in a context of increasing power of Big Techs in the digital environment. As its results, technical knowledge related to many areas and creativity are fundamental for the creation of the metaverse. Thus, its creation must be democratized. Public policies ensuring ways to access content creation must be developed, and such a democratization must be based on freedom of expression. And limitations to the exercise of such freedom must not be subjected to private interests of huge corporations, nor moderated solely by technological tools. Methodology: hypothetical-deductive method of procedure, with a qualitative and transdisciplinary approach, and a bibliographic review research technique.

Resumo Esta pesquisa analisa a importância da liberdade de expressão na criação do metaverso, em um contexto de crescente poder das Big Techs no ambiente digital. Como resultados, tem-se que o conhecimento técnico relacionado a diversas áreas e a criatividade são fundamentais para a criação do metaverso. Assim, sua criação deve ser democratizada. Políticas públicas que garantam formas de acesso à criação de conteúdo devem ser desenvolvidas, e tal democratização deve ser baseada na liberdade de expressão. E as limitações ao exercício dessa liberdade não devem ser submetidas a interesses privados de grandes corporações, nem moderadas apenas por ferramentas tecnológicas. Metodologia: método de procedimento hipotético-dedutivo, com abordagem qualitativa e transdisciplinar, e técnica de pesquisa de revisão bibliográfica.

Abstract This article explores the development of mandatory constitutional control of Chilean contentious-administrative processes. After discussing the integration of its procedural guarantees in the provisions that impose this control, the judgments of the Constitutional Court are studied, between the years 1981 and 2021. Case law allows to affirm that, although the restrictive terms of the Constitution have not prevented the integration of due process rights as parameters of the constitutionality of administrative litigation, only some procedural rights have been effective in the declaration of unconstitutionality. Paradoxically, these rights are those least adapted to the terms that impose this control.

Resumen Este artículo analiza el desarrollo del control constitucional obligatorio de los procesos contenciosos administrativos chilenos. Para tal efecto, luego de examinar la integración de sus garantías en las disposiciones que imponen este examen, se estudian las sentencias del Tribunal Constitucional pronunciadas en la materia, entre los años 1981 y 2021. La jurisprudencia permite afirmar que, aunque los restrictivos términos de la Constitución chilena no han impedido integrar los derechos del debido proceso como parámetros de constitucionalidad del contencioso administrativo, sólo algunas de sus garantías han sido efectivas en la declaración de inconstitucional. Paradojalmente, tales garantías son aquellas menos adaptadas a los términos que imponen este control.

Abstract This paper analyzes the recent Advisory Opinion OC-26/20 of November 9 issued by the Inter-American Court of Human Rights and presents some critical observations on two aspects. The American Convention on Human Rights was created in principle with the pretension of indefinite duration, but the States Parties were also careful to include a caveat. That notable caveat is the right to denounce the treaty. The denunciation is the exit door available to the parties to dissociate themselves from the Pact of San José. The last episode of denunciation by Venezuela in 2012-2013, together with its subsequent denunciation of the Charter of the Organization of American States in 2017-2019, raised concerns and questions in the region that led to the relevant advisory resolution in question.

Resumen Este trabajo analiza la reciente Opinión Consultiva OC-26/20 de 9 de noviembre emitida por la Corte Interamericana de Derechos Humanos y presenta algunas observaciones críticas sobre dos aspectos en particular. La Convención Americana sobre Derechos Humanos fue creada en principio con la pretensión de duración indefinida, pero los Estados parte también se cuidaron de plasmar una salvedad. Esa notable salvedad es el derecho de denuncia del tratado. La denuncia es la puerta de salida que tienen al alcance las partes para desligarse del Pacto de San José. El último episodio de denuncia protagonizado por Venezuela en 2012-2013, junto con la posterior denuncia que hizo de la Carta de la Organización de los Estados Americanos en 2017-2019, produjo preocupación e interrogantes en la región que derivaron en la relevante resolución consultiva en cuestión.

Resumo Este artigo desafia quatro pressupostos básicos e entrelaçados que informam o Direito Comparado ortodoxo: que um comparatista pode representar exatamente o Direito estrangeiro; que ele pode escrever sobre Direito estrangeiro objetivamente; que ele pode declarar a verdade sobre o Direito estrangeiro; e que ele desfruta do arbítrio subjetivo para superar os obstáculos no caminho para a realização desses objetivos. Sendo os comparatistas do Direito alheios à sua fraqueza cognitiva estrutural, que torna a busca dessas realizações irremediavelmente absurda, um forte programa contrário é necessário para trazer o Direito Comparado a seus sentidos epistemológicos e, no processo, aumentar a integridade acadêmica e confiabilidade de intervenções comparativas. Abstract This article challenges four basic and intertwining assumptions informing orthodox comparative law: that a comparatist can exactly represent foreign law; that he can write about foreign law objectively; that he can state the truth regarding foreign law; and that he enjoys the subjective agency to overcome the obstacles on the way to the achievement of these goals. Comparatists-at-law being oblivious to their structural cognitive weakness, which makes the pursuit of these realizations irredeemably preposterous, a strong contrarian programme is necessary so as to bring comparative law to its epistemological senses and, in the process, to heighten the scholarly integrity and reliability of comparative interventions.
