ABSTRACT Based on the discussion on Justice and Law fostered by Derrida in his book Force of Law: mystical foundation of Authority, we discuss in this article about the aporias with which we live in the routine of the PVC 21290 pre-university entrance exam, in relation to the affirmative policy of reserving vacancies. To do so, we bring a reflection on the spectrum of coloniality that hierarchizes people, dividing the min to those who should have access and those who should not have access to certain spaces, including public universities. However, understanding that affirmative policies are from the Law, therefore, of the order of predictability, we believe that they need to be in a continuous movement of improvement, a movement that imposes a responsibility on us, a radical investment in actions aimed at achieving Justice.
RESUMO A partir da discussão sobre Justiça e Direito trazida por Derrida em sua obra Força de Lei: o fundamento místico da autoridade, discorremos sobre as aporias com que convivemos na rotina do pré-vestibular PVC 21290, em relação à política afirmativa de reserva de vagas. Para tanto, trazemos uma reflexão sobre o espectro da colonialidade que hierarquiza as pessoas, dividindo-as entre as que devem ter acesso e as que não devem ter acesso a determinados espaços, incluindo nesses espaços as universidades públicas. Entretanto, entendendo que as políticas afirmativas são da ordem do Direito, portanto, da ordem do cálculo, acreditamos que elas precisam estar em um movimento contínuo de aprimoramento, movimento que nos impõe uma responsabilidade, um investimento radical em ações que visem alcançar a Justiça.
