RESUMO O presente estudo teve como finalidade apresentar e discutir as principais alterações trazidas pelo novo marco legal para a execução das políticas públicas de saneamento básico (Lei n° 14.026/2020), especialmente em relação a titularidade, contratos, concessões, universalização, sustentabilidade econômico-financeira, vetos, resíduos sólidos, entre outras. Além do caráter de análise normativa, buscou-se verificar a interligação entre o marco legal do saneamento básico e as demais políticas públicas de desenvolvimento urbano presentes na Constituição Federal, bem como a perspectiva de cumprimento das metas expostas pela nova lei. Infere-se, ao termo, que o cumprimento das metas estipuladas para tornar universal o direito ao saneamento básico, além da regulação criteriosa a ser realizada pelos entes responsáveis, necessita da avaliação periódica da efetividade dos instrumentos legais trazidos pelo novo marco legal.
ABSTRACT The purpose of this study was to present and discuss the main changes brought about by the new regulatory framework for the application of public policies on basic sanitation (Law No. 14.026/2020), especially in relation to ownership, contracts, concessions, universalization, economic-financial sustainability, vetoes, solid waste, among others. In addition to the character of normative analysis, it was sought to verify the interconnection between the regulatory framework for basic sanitation and other public policies for urban development present in the Federal Constitution, as well as the perspective of achieving the goals set out by the new law. It is inferred, at the end, that the fulfillment of the claimed goals to make universal the right to basic sanitation, in addition to the careful regulation to be carried out by responsible agencies, requires the periodic evaluation of the effectiveness of the legal instruments brought by the new regulatory framework.
