ABSTRACT This paper assesses how the Brazilian Supreme Court decided lawsuits and constitutional claims filed against Bolsonaro’s attacks to the Constitution during his mandate (2019-22), both in content and in timing. Data shows that, after a first year marked by a more conciliatory rhetoric, the Supreme Court started adopting a more responsive posture. The more Bolsonaro escalated his attacks, the more responsive became the Supreme Court.

RESUMO Neste artigo, analisamos a resposta do stf aos processos que questionaram os ataques à Constituição ocorridos durante o governo de Jair Bolsonaro (2019-22), em sua rapidez e conteúdo. Os dados revelam que, após uma primeira etapa marcada por uma retórica mais conciliadora, o STF passou a se mostrar cada vez mais disposto a controlar atos do governo. Quanto mais Bolsonaro intensificava seus ataques, mais responsivo se mostrava o STF.

RESUMO Este artigo revisita o contexto e as disputas políticas ocorridas durante a Assembleia Constituinte de 1987-1988 com o objetivo de identificar fatores institucionais que ajudem a explicar as características da Carta por ela promulgada e a justificar a preservação do cerne desta, a despeito da intensa série de emendas ao longo dos 30 anos de sua existência.

ABSTRACT This article revisits the context and the political struggles during the Constituent Assembly of 1987-1988, in order to explain the characteristic traits of the Constitution it drafted and to justify why the core of its text remained preserved despite the several amendments approved throughout the thirty years of its existence.

o STF está hoje no centro de nosso sistema político, fato que demonstra a fragilidade de nosso sistema representativo. tal tribunal vem exercendo, ainda que subsidiariamente, o papel de criador de regras, acumulando a autoridade de intérprete da constituição com o exercício de poder legislativo, tradicionalmente exercido por poderes representativos. Este texto mostra como o supremo, de fato, tem exercido tais funções pela análise de alguns de seus julgados mais recentes. Em seguida, propõe mecanismos capazes de lidar com as tensões produzidas pela supremocracia, sem caracterizá-la como algo necessariamente bom ou ruim, mas buscando compreender seu sentido e apontar para seus perigos.

The text shows how the fsc is located at the heart of our political system and warns of the dangers to democracy inherent in this stance. Such a danger lies in the fact that the aforementioned court is fulfilling, albeit in a subsidiary manner, the role of rule-maker, accumulating the authority of constitutional interpreter while retaining exercise of legislative power, which traditionally belonged to the representative powers. The text attempts to prove that the supreme court has carried out such functions within an analysis of some of its recently tried cases. It also suggests mechanisms capable of dealing with the tensions generated by supremocracy, without characterizing them as something good or bad for our political system.

The idea of Rule of Law has become almost unanimously embraced in our days. For human rights advocates, Rule of Law is perceived as an indispensable tool to avoid discrimination, and arbitrary use of force. But, how does profound and persistent social and economic inequality impact the integrity of the Rule of Law? The main objective of this essay is to try to understand the effects of the polarization of poverty and wealth on the legal system, especially in relation to one of the core ideals of the Rule of Law: that people should be treated impartially by the law and by those responsible for its implementation. By revising a substantive and a formalist conception of the Rule of Law, I will try to provide some explanation about why states and people would comply with the Rule of Law standards. The article will also consider the impact of extreme and persistent inequality over the Rule of Law, using my familiarity with the Brazilian experience as an example. In the final section, the focus will be on how even an incomplete Rule of Law system can be employed or challenged to empower the invisible, humanize the demonized, and bring the immune back to the realm of law. De que maneira a profunda e persistente desigualdade socioeconômica afeta a integridade do Estado de Direito? O principal objetivo deste artigo é procurar entender os efeitos, no sistema jurídico, da polarização entre pobreza e riqueza, especialmente com relação a uma das idéias centrais do Estado de Direito: a noção de que as pessoas devem ser tratadas de maneira imparcial pela lei e por aqueles encarregados de sua implementação. O argumento principal proposto aqui é que a exclusão social e econômica, decorrente de níveis extremos e duradouros de desigualdade, destrói a imparcialidade da lei, causando a invisibilidade dos extremamente pobres, a demonização daqueles que desafiam o sistema e a imunidade dos privilegiados, aos olhos dos indivíduos e das instituições. Em suma, a desigualdade socioeconômica extrema e persistente corrói a reciprocidade, tanto em seu sentido moral quanto em seu interesse mútuo, o que enfraquece a integridade do Estado de Direito. En la actualidad la idea del Estado de derecho está aceptada casi unánimemente. Los defensores de los derechos humanos ven en el Estado de derecho una herramienta indispensable para evitar la discriminación y el uso arbitrario de la fuerza. ¿Cómo influye la profunda y persistente desigualdad social y económica en la integridad del Estado de derecho? El objetivo principal del presente ensayo es tratar de comprender los efectos de la polarización de la pobreza y de la riqueza en el sistema jurídico, especialmente con relación a uno de los ideales esenciales del Estado de derecho: que la ley y los responsables de la implementación de dicho Estado de derecho traten a la gente con imparcialidad. Mediante una revisión de la concepción sustantiva y de la formalista del Estado de derecho, intentaré proporcionar al menos alguna explicación a por qué los estados y los pueblos cumplen con los estándares del Estado de derecho. El artículo también considerará el impacto de la desigualdad extrema y persistente en el Estado de derecho, basándome en mi conocimiento de la experiencia brasileña como ejemplo. La sección final se concentrará en el hecho de que incluso un sistema incompleto de Estado de derecho puede ser usado y puesto a prueba para darle más poder a los invisibles, para humanizar a los demonizados, y para traer otra vez a los inmunes al reino de la ley. Por que nossas sociedades ainda aceitam, e até mesmo perpetuam, violações aos direitos humanos? Na primeira parte deste artigo discutimos por que as pessoas, individualmente, respeitam ou deixam de respeitar os direitos das demais. Entre outros fatores, esse desrespeito emerge da persistente desigualdade que cria a exclusão moral e, conseqüentemente, promove a invisibilidade dos excluídos e a demonização dos que lutam por seus direitos. A segunda parte do texto mostra o papel crucial da sociedade civil que, com seus variados interesses, proporciona um discurso plural, torna públicas as injustiças, protege o espaço privado, interage diretamente com os sistemas legais e políticos e promove a inovação social. Tendo em vista montar uma agenda que fortaleça a futura discussão dos direitos humanos, os autores sugerem três estratégias: aperfeiçoamento da capacidade de comunicação e educação; investimento em alternativas inovadoras como, por exemplo, a abordagem proativa, e a implantação de redes que proporcionem um diálogo ativo entre diversidades.

Why do our societies still accept and even perpetuate human rights violations? The first part of this paper discusses why individuals respect or do not respect other people's rights. Disrespect for rights emerges, among other factors, from persistent inequality that creates moral exclusion and, consequently, promotes the invisibility and demonization of those who struggle for their rights. The second part of this paper explores the role of civil society, which, with its variety of interests, provides for a plural discourse, publicizes injustice, protects private space, interacts directly with legal and political systems and drives social innovation. Towards an agenda for strengthening the future human rights discourse, the authors suggest three strategies: improving communication and educational capacity, investing in innovative models, and building and strengthening networks that will ensure an active dialogue among diversities.

¿Por qué nuestras sociedades aún aceptan, y hasta perpetúan, violaciones a los derechos humanos? En la primera parte de este artículo analizamos por qué las personas, individualmente, respetan o dejan de respetar los derechos de las demás. Entre otros factores, esa falta de respeto surge de la persistente desigualdad que crea la exclusión moral y, por consiguiente, promueve la invisibilidad de los excluidos y la demonización de los que luchan por sus derechos. La segunda parte del texto muestra el papel crucial de la sociedad civil que, con sus variados intereses, proporciona un discurso plural, hace públicas las injusticias, protege el espacio privado, interactúa directamente con los sistemas legales y políticos y promueve la innovación social. Con vistas a construir una agenda que fortalezca la futura discusión de los derechos humanos, los autores sugieren tres estrategias: el perfeccionamiento de la capacidad de comunicación y educación; la inversión en alternativas innovadoras, como por ejemplo el abordaje proactivo, y la implantación de redes que proporcionen un diálogo activo entre diversidades.

Examina-se a questão das cláusulas que impõem restrições à mudança constitucional. Discutem-se as principais interpretações dos problemas e paradoxos que emergem quando a questão é vista da perspectiva de exigências democráticas. Argumenta-se que clásulas super-constitucionais são aceitaveis desta perspectiva quando protegem os princípios democráticos da Constituição. Isto signfica que uma teoria coerente das cláusulas super-constitucionais deve basear-se na defesa das condições que permitam o auto-governo por indivíduos livres e iguais com base em procedimentos justos. Aplica-se isso ao caso da Constituição brasileira de 1988.

The question of the clauses imposing restrictions on constitutional change is examined. The main interpretations concerning the problems and paradoxes raised when the question is viewed from the standpoint of the democratic demands are discussed. It is argued that those clauses area reasonable from this perspective whenever they protect the democratic principles of the Constitution. This means that a coherent theory of the supra-constitutional clauses ought to have at its foundations the defence of the conditions which allow the self-government of free and equal individuals on the basis of just procedures. This is applied to the case of the Brazilian Constitution of 1988.
