Resumo O objetivo do presente artigo é verificar a legalidade dos fundamentos jurídicos empregados pelo estado de Roraima na Ação Civil Originária (ACO) n. 3.121, cujos pedidos consistem em “impedir que o fluxo migratório desordenado produza efeitos mais devastadores à sociedade brasileira, em específico no Estado de Roraima” e que a União “feche temporariamente a fronteira Brasil-Venezuela” ou “seja compelida a limitar o ingresso de refugiados venezuelanos”. São analisados os autos do processo, bem como a aplicabilidade dos discursos teórico-dogmáticos empregados, especialmente referências ao pós-positivismo e ao Estado de Coisas Inconstitucional (ECI). Conclui-se que os pedidos de fechamento das fronteiras e de limitação do número de ingresso de refugiados devem ser julgados improcedentes, por violarem obrigações internacionais de direitos humanos assumidas pelo Brasil, especialmente aquelas de proteção aos refugiados ( ex vi da Convenção de Genebra relativa ao Estatuto dos Refugiados de 1951 e dos arts. 1º, inciso III, e 7º da Lei n. 9.474/1997). Avalia-se, ainda, que as referências ao pós-positivismo e ao ECI são realizadas de forma retórica, visando legitimar a adoção de uma postura ativista pelo Poder Judiciário. Quanto à metodologia, retrata pesquisa pura, qualitativa e descritiva. O método de abordagem é indutivo crítico, de interpretação sistemática e procedimentos técnicos documentais.

Abstract This paper aims to verify the legality of the legal bases used by the State of Roraima in the Original Civil Action n. 3.121, whose requests consist of “preventing the disordered migratory flow from producing more devastating effects on Brazilian’s society, specifically in the State of Roraima”, and that the Federal Union “temporarily close the Brazil-Venezuela border” or “be compelled to limit the entry of Venezuelan refugees”. The case files are analyzed, as well as the applicability of the theoretical-dogmatic discourses used, especially the references to post-positivism and Unconstitutional State of Fairs. The conclusion is that the requests for closure of borders and limitation of the number of refugees must be dismissed, because they directly violate international human rights obligations committed by Brazil, especially those for the protection of refugees ( ex vi of the Geneva Convention of 1951 concerning to the Status of Refugees and article 1, item III and article 7 of Law n. 9.474/1997). It is also noted that references to post-positivism and Unconstitutional State of Fairs are made rhetorically, to legitimize the adoption of an activist stance by the Judicial Power. Regarding the methodology, it is a pure, qualitative and descriptive research. The approach method is critical inductive, with systematic interpretation and documentary technical procedures.

Resumo O estudo aborda o conceito de interseccionalidade das opressões ou desigualdades interseccionais - cunhado em 1989, por Kimberlé Crenshaw - e seu potencial analítico para a concretização do acesso das mulheres aos Direitos Humanos. Por meio de revisão bibliográfica e documental, de aplicação do método hipotético-dedutivo, a pesquisa possui caráter descritivo e explicativo. Conclui-se que as discriminações de gênero interagem com outras categorias estruturais, como raça, produzindo processos de exclusão particulares que são barreiras no acesso a direitos, sendo a interseccionalidade uma ferramenta com grande potencial para melhor compreender esses processos e minimizá-los.

Abstract The research is about the study of the concept of intersectionality of oppression or intersectional inequality - coined in 1989, by Kimberlé Crenshaw - and its analytical potential for the realization of women's access to Human Rights. Through bibliographical and documentary review, and the application of the hypothetical-deductive method, the research has a descriptive and explanatory character. It is concluded that gender discrimination interacts with other structural categories, such as race, producing particular exclusion processes that are barriers in accessing rights, with intersectionality being a tool with great potential to better understand these processes and minimize them.

Resumo Detalhou-se a repercussão da Operação Lava Jato no Brasil sobre a arbitragem comercial internacional no Caso Vantage v. Petrobras, de 2018, relativamente à defesa pautada em nulidades contratuais vinculadas à corrupção na obtenção do contrato basilar da relação jurídica. O problema de pesquisa consistiu na seguinte indagação: como se deu a repercussão da Lava Jato sobre a arbitragem comercial no caso Vantage v. Petrobras? Lançou-se a hipótese de que aludida repercussão teve alcance limitado e com parcial e possível prejuízo à defesa da Petrobras em esfera internacional. Abordou-se a negociação de acordo de fornecimento de serviços de perfuração de águas superprofundas por navio-sonda da Vantage à Petrobras, a força-tarefa da Lava Jato, bem como tratou-se do procedimento arbitral aberto pela Vantage a partir da rescisão unilateral do contrato de afretamento obtido mediante corrupção. A pesquisa caracterizou-se como qualitativa, de método indutivo e técnica descritiva, com recurso à análise bibliográfica. Concluiu-se que a Operação Lava Jato repercutiu na arbitragem internacional na medida em que o fruto de suas investigações e procedimentos de colaboração premiada motivaram a rescisão unilateral antecipada do pacto por violações contratuais, contestada pela Vantage, porém não influenciou a sentença arbitral a respeito das nulidades arguidas pela Petrobras.

Abstract The main scope of the article is to detail the repercussions of Operation Car Wash in Brazil on international commercial arbitration procedures in Vantage v Petrobras (2018), with regards to the defense allegations that corruption in the securing of a contract deem it void or voidable. In this sense, it was wondered: how Car Wash reflected on commercial arbitration in Vantage v. Petrobras? The hypothesis is that its reflex was limited, with partial and possible prejudice to Petrobras’ defense in the arbitration. The study exposes the procurement of an agreement to provide drilling services in deep waters by Vantage to Petrobras, the Car Wash task-force, and it also deals with the arbitral procedure initiated by Vantage upon unilateral termination of the leasing contract obtained through corruption. It is a qualitative research, conducted through the inductive method, which employs descriptive analysis and bibliographical review. We conclude that Operation Car Wash had repercussions on the international arbitration, consistent with the findings of the investigation and plea deals motivated the early termination for contractual breaches also, fought by Vantage, but it has not influenced the arbitral award with regards to contractual annulment counterclaims made by Petrobras.

Resumo Partindo do conceito da interseccionalidade, a presente pesquisa analisa as ações do Estado brasileiro em prol da concretização da Convenção sobre Eliminação de Todas as Formas de Discriminação contra a Mulher (CEDAW). Tais ações foram apresentadas nos Relatórios que o Brasil enviou ao Comitê CEDAW (1984-2014). Esses documentos, organizados via análise de conteúdo, revelaram que a postura nacional tem sido de ignorar os elementos interseccionais das discriminações, mesmo quando diante de chamados específicos do Comitê CEDAW. A metodologia foi pura, dedutiva e descritiva.

Abstract Actions by the Brazilian state implement the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) are analyzed based on the concept of intersectionality. These actions were presented in reports sent by the Brazilian state to the CEDAW Committee (1984-2014). These documents, organized with content analysis, reveal that the national position has been to ignore the intersectional elements of discrimination, even when faced with specific calls from the CEDAW Committee. The methodology was pure, deductive and descriptive.

O Direito disciplina, para além da moral, a fenomenologia social exigindo olhar multidisciplinar e interdisciplinar; ainda, identificando, na formalidade legal, a realidade social. A Ciência Econômica confere eficácia ao Direito, relevadas, no cálculo econométrico próprio da eficiente tomada de decisão normativo-jurídica, variáveis próprias de inclusão social. Este artigo objetiva identificar o Princípio da Eficiência Econômico-Social (PEES); justificando-se pela necessidade de delimitar categoria teórica distinta de interação econômico-jurídica. Trata-se de pesquisa qualitativa exploratória, de procedimento monográfico, de abordagem dedutiva e técnica de pesquisa bibliográfica. O artigo conclui pela criação e aplicação de Direito, socialmente inclusor; progressista, eficaz e eficiente; atento ao contexto econômico, político e jurídico tal como preconizado pelo Princípio da Eficiência Econômico Social.

The Law disciplines the social phenomenology forward the moral and it requires a multi and interdisciplinary vision to identify the social reality on the legal formality. The Economic Science gives effectiveness to the Law, if considered the variables of social inclusion at the economic calculus appropriated to the efficient normative and juridical decision. This article objective to identify the Social and Economic Efficiency Principle (SEEP). It's justified by the necessity to delimitate a distinct and theoretical category from the interaction between Economic Science and Law. It´s a qualitative and exploratory research, with monographic procedure and deductive boarding and research technique is bibliographic. It concludes by the Law´s creation and application that be socially inclusive; progressive, effectiveness and efficient; dealing with juridical, political and economic context like expressed by the Social and Economic Efficiency Principle.
