Resumo O artigo discute a atuação da Promotoria de Justiça de Direitos Humanos da Inclusão Social do Ministério Público de São Paulo no combate à discriminação. Por meio de um estudo etnográfico, analisa o modo como a Promotoria se posiciona em relação a quatro tensões que instituições jurídicas enfrentam na luta antidiscriminatória: entre solucionar conflitos pontuais ou buscar transformações de caráter estrutural (pontual/estrutural); entre utilizar instrumentos de repressão ou realizar medidas de prevenção de violações de direito (repressão/prevenção); entre definir estruturas internas para os cidadãos, entendidos de forma abstrata, ou direcionar práticas institucionais para grupos específicos de maior vulnerabilidade social (universal/específico); e entre uma visão tecnicista e neutra do profissional do Direito ou uma percepção do profissional como indutor de mudanças sociais a partir do diálogo com a sociedade civil (técnico/político). Foi possível concluir que, apesar de inúmeros desafios e limitações, a Promotoria possui uma sensibilidade inovadora para o enfrentamento da discriminação, tanto no âmbito do Ministério Público quanto no sistema de justiça como um todo: dialoga e estabelece acordos com diferentes organizações, promove eventos de capacitação e busca o reconhecimento de necessidades específicas de grupos discriminados em políticas públicas.

Abstract This article discusses the practices of the Promotoria de Justiça de Direitos Humanos da Inclusão Social from the Ministério Público de São Paulo (Promotoria) in the fight against discrimination. By means of an ethnographic research, it analyzes the way in which the Promotoria positions itself in relation to four tensions faced by legal institutions when dealing with cases of discrimination: between solving a particular case or achieving social change of a structural nature (particular/structural); between utilizing instruments of repression or promoting measures to prevent the violation of rights (repression/prevention); between defining organizational structures for the citizen, seen as a universal concept, or directing institutional practices towards specific socially vulnerable groups (universal/specific); and between a technical and neutral view of the legal professional or a perception of the professional as promoting social impact through a dialogue with the civil society (technical/political). Despite facing many difficulties and challenges, the Promotoria displays an innovative sensitivity within the Ministério Público and among other institutions of the justice system. The institution carries out strategies that go beyond individual accountability: based on dialogue and agreements with different social actors, it seeks to promote educational measures, changes in institutional practices and improvements in public policies.

Resumo A análise visa identificar o papel da Defensoria Pública na promoção do reconhecimento às diferenças. Será apresentado o contexto normativo para a proteção de grupos estigmatizados pela instituição e, com base na formulação teórica de Nancy Fraser, uma proposta de caracterização desses grupos. Em seguida, serão analisados desafios e possibilidades de práticas institucionais da Defensoria Pública do Estado de São Paulo que podem favorecer o reconhecimento das diferenças: os Núcleos Especializados, as ações afirmativas, a produção de dados e os mecanismos de participação popular. A partir dessa análise, será possível construir a hipótese de que apesar de o foco das atribuições da Defensoria Pública ser atender àqueles carentes de recursos econômicos, o não reconhecimento de diferenças produz obstáculos ao acesso à justiça e à paridade participativa, que devem ser enfrentados pela instituição. Há muitos desafios a serem enfrentados para o reconhecimento das diferenças nas práticas institucionais da Defensoria Pública. Uma reflexão profunda sobre o tema é necessária. A proposta deste artigo é apenas iniciá-la.

ABSTRACT This essay intends to investigate the role of the Public Defender’s Office in promoting the recognition of difference. The normative context for the protection of stigmatized groups and a proposal for the characterization of these groups in accordance with Nancy Fraser’s theory will be presented. Subsequently, the challenges and Public Defender’s Office institutional practices that may be favorable to the recognition of differences such as Specialized Centers Offices, affirmative action, data production and the means for public participation will be analyzed. Based on this analysis, it will be possible to raise the hypothesis that although the aim of the Public Defender’s Office is to work for those who lack sufficient financial resources, the non-recognition creates obstacles to the access of justice and to participatory parity that must be overcome by the institution. There are many challenges to be faced in order to have the recognition of difference in the Public Defender’s Office institutional practices. An in-deep reflection over this subject is mandatory. The main objective of this article is to instigate it.
