Resumo: As sociedades contemporâneas fizeram da sexualidade, dos afetos e do desejo categorias centrais no que diz respeito à construção da subjetividade do sujeito, de modo que a concretização dos direitos humanos atravessa, invariavelmente, os corpos e as sexualidades. Nesse sentido, este texto intenta fazer apresentar, de forma bem obje-tiva, uma análise jurisprudencial representativa das mais altas Cortes jurisdicionais, nacionais ou internacionais, e em cujo cerne circulam as questões do gênero e da sexualidade. A escolha dos casos levou em consideração os critérios geográfico-espacial e cronológico, selecionando-se os entendimentos mais relevantes dos tribunais de países ocidentais e ocidentalizados, mas com diferentes realidades culturais, sociais e eco-nômicas, para além de decisões envolvendo Cortes regionais de proteção de direitos humanos. Ao final, evidencia-se que o Direito, por meio dos tribunais, vem enfrentando, incorporando e narrando esses novos temas, sinalizando para uma importante mudança de paradigma em termos de justiça de gênero e sexualidade.

Abstract: Contemporary societies have made sexuality, affections, and desire central categories regarding the construction of the subjectivity of the subject, so that the realization of human rights invariably crosses bodies and sexualities. In this sense, this text intends to present, in a very objective way, a jurisprudential analysis representative of the highest jurisdictional Courts, national or international, and at the heart of which issues of gender and sexuality circulate. The choice of cases considered the geographic-spatial and chronological criteria, selecting the most relevant understandings of the courts of western and westernized countries, but with different cultural, social and economic realities, in addition to decisions involving Regional Courts for the protection of human rights. In the end, it is evident that the Law, through the courts, has been facing, incorporating, and narrating these new themes, signaling an important paradigm shift in terms of gender and sexuality justice.

Resumo Este texto tem como objetivo analisar de que maneira o tema dos direitos sexuais vem sendo incorporado à agenda do Sistema Interamericano de Direitos Humanos, especialmente no que diz respeito à temática das pessoas transgêneras e transexuais. Para tanto, vale-se de importante e recente Opinião Consultiva (OC) 24/17, sem deixar de perceber os relevantes reflexos deste instrumento no direito pátrio brasileiro, especialmente a partir da Ação Declaratória de Inconstitucionalidade (ADI) 4275/DF, do Supremo Tribunal Federal, evidenciando-se um possível e fecundo diálogo das Cortes. O método utilizado é o fenomenológico hermenêutico.

Abstract This text aims to analyze how the issue of sexual rights has been incorporated into the agenda of the Inter-American Human Rights System, especially with regard to the issue of transgender and transsexual persons. For this, it is based on an important and recent Consultative Opinion (OC) 24/17, without neglecting to perceive the relevant reflexes of this instrument in the Brazilian homeland law, especially from the Declaratory Action of Unconstitutionality (ADI) 4275/DF, of the Federal Supreme Court, evidencing a possible and fruitful dialogue of the Courts. The method used is the phenomenological hermeneutic.

Resumo: Neste texto intentamos analisar o Caso Gonzales Lluy vs. Equador, da Corte Interamericana de Direitos Humanos, cujo decisum condenou o Estado réu pelas violações de direitos humanos de Talía Gabriela Gonzales Lluy em virtude de contágio pelo vírus HIV. O estudo leva em consideração especialmente as temáticas da diferença e da(s) vulnerabilidade(s), as quais saltam aos olhos nesta demanda, delineando todo o julgamento que, afinal, reconheceu a discriminação interseccional a que foi submetida Talía. A partir de revisão crítico-reflexiva dos temas pautados e da utilização da fenomenologia hermenêutica, neste texto pretendemos evidenciar que o caso ora em discussão pode se constituir, guardadas as devidas proporções, em um importante precedente da Corte Interamericana em termos de direitos econômicos, sociais e culturais.

Abstract: This text attempts to analyze the case Gonzales Lluy vs. Ecuador, of the Inter-American Court of Human Rights, whose decision condemned the defendant State for the human rights violations of Talía Gabriela Gonzales Lluy due to HIV infection. The study takes into account, in particular, the issues of difference and vulnerability(ies), which stand out in this demand, delineating all the judgment that, after all, recognized the intersectional discrimination that was submitted to Talía. Based on a critical-reflective review of the themes and the use of hermeneutic phenomenology, this text intends to show that the case under discussion can be constituted, in due proportion, in an important precedent of the Inter-American Court in terms of economic, social, and culture.

O presente texto pretende demonstrar que a identidade tem se transformado numa categoria essencial para se compreender os conflitos contemporâneos. Diferentemente de suas formas tradicionais de identificação, a identidade tem se estratificado, se tornado múltipla, reclamando reconhecimento jurídico para as suas diferentes formas de produção de pertença. Destaca-se que o corpo, para além de sua biologia, reclama e constitui uma identidade que garante uma biografia, a fala e sua particular forma de ser no mundo. Por fim, defende- se que, apropriada pelo direito, a identidade é reduzida a um modo de identificação. O direito constitui normativamente a identidade descaracterizando-a.

This paper aims to show that identity has become an essential category to understand contemporary conflicts. Different from its traditional forms of identification, identity turned to stratify, getting multiple, claiming legal acknowledgement for its several forms of belonging production. We stress that human body, beyond its biology, claims and constitutes an identity that assures its biography, its speech and its specific way of being. Finally it is maintained that if identity is adopted by Law, identity becomes reduced to an identification modus. In terms of norms, Law constitutes identity taking him its character.
