Abstract: Based on historical institutionalism, this article assesses the interactions between the Brazilian state, the Inter-American Commission on Human Rights and pro-indigenous organizations during the proceedings of the Yanomami case between 1980 and 1985. Methodologically, we analyzed primary sources from the Ministry of Foreign Affairs to map the interests, strategies and impacts of these actors´ actions. Despite Brazilian pressure against the case, the Commission’s discretion and cleavages among its members coalesced with the external political context, allowing for the strengthening of the Commission and of a transnational indigenist network. These factors resulted in a decision by the Commission that urged the state to guarantee the demarcation of the Yanomami lands.

Resumo: Com base no institucionalismo histórico, o artigo avalia as interações entre Estado brasileiro, Comissão Interamericana de Direitos Humanos e organizações peticionárias pró-indígenas durante a tramitação da denúncia do caso Yanomami entre 1980 e 1985. Metodologicamente, a análise de fontes primárias do Ministério das Relações Exteriores permitiu reconstruir interesses, estratégias e o alcance das ações desses atores. Conclui-se que, apesar das pressões do Brasil contra o caso, a discricionariedade da Comissão e as clivagens entre seus membros se combinaram com o contexto político externo, o qual havia permitido um fortalecimento institucional da Comissão e projetado uma rede transnacional indigenista. Tais fatores resultaram em uma decisão da Comissão que instou o Estado a garantir a demarcação das terras indígenas Yanomami.

RESUMO Introdução: Neste estudo de caso da organização não governamental mexicana Centro de Direitos Humanos das Mulheres, discuto interpretações teóricas de Relações Internacionais sobre vínculos entre ativismo profissional, vítimas e atores de base. Analiso se a atuação de organizações não governamentais institucionalizadas pode gerar efeitos sóciopolíticos emancipatórios ou se, ao contrário, leva à desmobilização e ao silenciamento de demandas pró-direitos. Materiais e Métodos: Com base em entrevistas semiestruturadas e fontes secundárias, a pesquisa apresenta a trajetória institucional, repertórios de ação e perfil das pessoas fundadoras do Centro de Direitos Humanos das Mulheres do México. A hipótese foi a de que, nas práticas das organizações não governamentais, tanto formas de atuação mais e menos institucionalizadas, como ações de colaboração ou de confronto podem conviver sem que isso implique o afastamento desses grupos de suas bases sociais. Resultados: Contrariamente ao que é normalmente esperado pela literatura, a organização estudada equilibra dois papéis institucionais distintos ao mesmo tempo: o ativismo militante e a defesa legal. Isso lhe permite manter conexão com a radicalidade das lutas sociais e avançar em ações institucionalizadas junto ao Estado e a instâncias da governança global. Discussão: A literatura precisa enfocar melhor as interações reais entre instituições, organizações não governamentais e vítimas. É necessário problematizar as interpretações que enxergam o ativismo profissional apenas como um mercado tecnocrático do Norte global. É preciso olhar para as histórias locais de mobilização dos direitos humanos.

ABSTRACT Introduction: In this case study of the Mexican non-governmental organization (NGO) Center for Women’s Human Rights, I discuss theorical interpretations regarding professional activism, victims, and grassroots actors. I analyze if non-governmental organizations actions can generate emancipatory sociopolitical effects, or if, on the contrary, they lead to demobilization and silencing of pro-rights demands. Material and Methods: Based on semi structured interviews and secondary sources, the research shows the institutional path, action repertoires and the profiles of founders of the Center for Women’s Human Rights of Mexico. The hypothesis was that, in the face of decision-making arenas, more and less institutionalized forms of action can coexist without this implying the separation of these groups from their social bases. Results: Contrary to literature expectations, the studied organization balances two distinct institutional roles at the same time: militant activism and legal defense. This allows it to maintain connection with radical social struggles and advance in institutionalized actions with the State and global governance bodies. Discussion: The literature needs to delve into the real interactions between institutions, NGOs, and victims. It is necessary to question the interpretations which understand professional activism only as a technocratic market of the global North, looking upon the local histories of human rights mobilization.

Resumo O objetivo deste artigo é o de analisar a atuação da organização não governamental (ONG) mexicana Centro de Direitos Humanos das Mulheres (CEDEHM) no caso Alvarado contra o México, perante o sistema interamericano, a fim de revelar a importância da intermediação político-legal para os debates teóricos sobre a mobilização de normas internacionais de direitos humanos. O argumento central é de que o tipo de intermediação estabelecida pelas ONGs entre vítimas e esferas institucionais é central para determinar se a mobilização dos direitos humanos terá impacto contestatório ou conservador. No caso Alvarado, a intermediação desempenhada pelo CEDEHM concede uma posição central para as vítimas e familiares, contribuindo decisivamente para a formação da agência política desses atores e para a politização da própria linguagem dos direitos humanos.

Abstract This article aims to analyze the performance of the Mexican non-governmental organization (NGO) Center for Women’s Human Rights (CEDEHM) in the Alvarado case against Mexico within the Inter-American human rights system. With that, it seeks to reveal the importance of political-legal intermediation on theoretical debates about the mobilization of international human rights norms. The main argument is that the intermediation established by NGOs between victims and institutional spheres is central to determine whether human rights mobilization will have a disruptive or conservative impact. In the Alvarado case, the intermediation performed by CEDEHM assigns a central role to victims and their families, contributing to the formation of their political agency and to the politicization of the human rights language.

Resumo O objetivo deste artigo é analisar como e por que a normatividade do Sistema Interamericano de Direitos Humanos (SIDH) sobre o tema da justiça de transição tem encontrado obstáculos para o seu impacto no Brasil. A partir de um desenho de pesquisa qualitativa que se baseou na realização de entrevistas, além da consulta a fontes secundárias e sentenças judiciais, argumenta-se que a ausência de Organizações Não Governamentais (ONGs) litigantes e com capacidade de atuação transnacional interessadas na agenda de justiça de transição compromete o impacto do SIDH. Além disso, a continuidade institucional do Supremo Tribunal Federal (STF), bem como sua composição e cultura jurídica herdadas da ditadura, contribuíram para preservar a irrelevância do direito internacional dos direitos humanos dentro do tribunal e reforçar,no processo de revisão judicial, a prática do “positivismo à la carte”(Ventura, 2011), que extrapola a análise do texto escrito da lei e adota, convenientemente, outras matrizes exegéticas, como o método histórico utilizado durante o exame da Lei de Anistia, mesmo quando isso implica a manutenção do legado da legislação autoritária, da qual o STF erigiu-se como grande defensor junto das Forças Armadas.

Abstract The aim of this article is to analyze how and why the impact of the norms of the Inter-American Human Rights System on transitional justice has been hindered in Brazil. In this sense, a qualitative research design based on interviews was adopted, in addition to the consultation of secondary sources and courts’ rulings. In this sense, I argue that the lack of capable litigant Non-governmental Organizations (NGOs) interested in acting transnationally on transitional justice issues compromises the impact of the Inter-American System. Moreover, the institutional preservation of the Federal Supreme Court (STF) as well as its composition and juridical culture inherited from the dictatorship have contributed, on the one hand, to the irrelevance of the human rights international law within the court. On the other hand, during the judicial revision process, these factors have also strengthened the practice of “positivism à la carte” (Ventura, 2011) that extrapolates the analysis of the written law in favor of other convenient exegetical matrices, as the historical method used in light of the amnesty law, even when that implies sustaining the authoritarian legal system’s legacy, which the STF has defended along with the Armed Forces.

Abstract Recently, the Federal Prosecution Service has embraced the agenda of individual criminal accountability for human rights violations committed by the military dictatorship. This article aims to reconstruct such process of institutional change, analyzing the effects of the Inter-American Court of Human Rights’ ruling on the Gomes Lund case, and how it has favored a more progressive group of pro-compliance prosecutors.

Resumo O objetivo do artigo é analisar como e por que a normatividade do Sistema Interamericano de Direitos Humanos sobre o tema de justiça de transição pôde exercer influência sobre o processo de judicialização de casos de violações de direitos humanos no Peru. Partindo da abordagem emergente na literatura de que os efeitos dos regimes internacionais de direitos humanos são condicionados por fatores domésticos dos países aos quais se dirigem suas normas e pressões, a pesquisa buscou delinear como a política doméstica influencia e medeia o impacto potencial dessas normas internacionais, salientando o papel de Organizações Não Governamentais (ONGs) e da cúpula do Judiciário local, já que tais atores são centrais tanto para o processo de justiça de transição quanto para a ativação e aplicação da normatividade do Sistema Interamericano. Nesse sentido, a partir de um desenho de pesquisa qualitativo que se baseou na realização de entrevistas semiestruturadas com atores da sociedade civil e magistrados envolvidos com a temática, além da consulta a fontes secundárias e sentenças judiciais, testamos a hipótese segundo a qual o Sistema Interamericano adquirirá aderência doméstica se e quando esses atores forem capazes de entendê-lo e instrumentalizá-lo como um mecanismo efetivo para o seu “empoderamento”. Feita a análise dos dados coletados, assinalamos então, em primeiro lugar, que o perfil dos grupos de direitos humanos foi essencial para as perspectivas de impacto, já que a expertise e atuação contínua desses atores foi o que lhes permitiu atrair a atenção do sistema e desempenhar o papel de agentes de difusão e de legitimação de suas construções e formulações jurídicas. Já no que diz respeito à receptividade e abertura do Judiciário, argumentamos que foi decisiva a existência, no período pós-transicional, de um grupo de magistrados previamente dissidentes ou de perfil mais progressista e ativista nas principais esferas judiciais responsáveis pelos casos de violações de direitos humanos. Esses magistrados instrumentalizaram, na conjuntura crítica de reconstrução e renovação dos quadros do Judiciário, as decisões do Sistema Interamericano como um mecanismo de fortalecimento institucional, contribuindo, por conseguinte, para sua aplicação interna. Assim, contrariamente à maioria dos estudos que privilegiam a ação do Executivo para explicar seja a realização de julgamentos no período pós-transicional, seja o impacto de normas e pressões internacionais de direitos humanos, as conclusões apontam para a necessidade de que as agendas de pesquisa sobre o regime internacional de direitos humanos e justiça de transição atentem mais para o papel e o perfil dos atores judiciais e organizações litigantes de direitos humanos, já que a realização de novos julgamentos passa muitas vezes pela mobilização de uma normatividade internacional que não pode ser entendida de maneira divorciada da agência de ONGs e magistrados.

The aim of this article is to analyse how and why the norms of the Inter-American human rights system on transitional justice exerted an impact on the human rights trials in Peru. Based on the emerging theoretical approach according to which the effects of international human rights regimes are conditioned by domestic factors of the target-countries, our research seeks to unravel how domestic politics influences and mediates the potential impact of these international norms, highlighting the role of non-governmental organizations (NGOs) and local higher courts, since these actors are central both to the process of transitional justice and for the activation and enforcement of the Inter-American system’s rules. In this sense, a qualitative research design based on semi-structured interviews with civil society actors and judges involved with the theme was adopted, in addition to the consultation of secondary sources and courts’ rulings. Then, from the analysis of this material, we tested the hypothesis that the Inter-American system will have a domestic impact if and when NGOs and local judges are able to understand and use it as an effective mechanism for their own “empowerment”. Having analyzed the data collected, we point out, firstly, that the human rights groups’ profile was essential for the impact, since the expertise and continuous actions of these actors allowed them not only to attract the Inter-American system’s attention, but also to act as agents that would propagate and legitimate its legal formulations. Secondly, in what concerns the responsiveness and openness of the judiciary, we also point out to the important presence of a group of more progressive and dissident judges in the main tribunals during the post-transitional period. In that critical juncture when the reconstruction and renovation of the judiciary was at stake, these magistrates used the Inter-American system’s decisions as a mechanism for their own institutional strengthening, contributing therefore to the enforcement of such rules. Therefore, contrary to most studies that focus on Executive’s actions to explain either the occurrence of human rights trials in the post-transitional period, or the impact of international human rights norms, our conclusions urge the research agendas on the human rights international regime and transitional justice to pay more attention to the role and profile of judicial actors and domestic litigants, since human rights trials frequently are anchored on the mobilization of international norms that cannot be understood separately from the agency of NGOs and magistrates.

O objetivo deste artigo é analisar como e por que as normas do sistema interamericano de direitos humanos sobre justiça de transição presentes na sentença do caso Rosendo Radilla contra o Estado mexicano exerceram impacto em questões de direitos humanos no México, especialmente no que diz respeito à jurisdição militar e ao controle de convencionalidade. A partir da abordagem teórica emergente, segundo a qual os efeitos dos regimes internacionais de direitos humanos são condicionados por fatores domésticos dos países-alvo, nossa pesquisa busca delinear como a política interna influencia o impacto potencial dessas normas internacionais que integram a cascata de justiça, salientando para tanto o papel de organizações não governamentais (ONGs) e da Suprema Corte local.

Based on the emerging theoretical approach according to which the effects of international human rights regimes are conditioned by domestic factors of the target-countries, our research seeks to unravel how domestic politics influences the potential impact of these international norms that comprise the justice cascade, highlighting the role of non-governmental organizations (NGOs) and the local higher court.

O objetivo deste artigo é analisar a influência da normatividade do sistema interamericano de direitos humanos em um caso de justiça de transição envolvendo a Lei de Justiça e Paz na Colômbia. O argumento defendido é o de que a dinâmica e o caráter da interação entre juízes e organizações não governamentais (ONGs) domésticas de direitos humanos foram os fatores que moldaram o impacto do sistema interamericano.

The aim of this article is to analyze the influence of the norms produced by the Inter-American Human Rights System in a case of transitional justice involving the Justice and Peace Law in Colombia. The author argues that the dynamics and character of the interaction between judges and domestic human rights non-governmental organizations (NGOs) were the factors that shaped the impact of the Inter-American system.

O objetivo deste artigo é analisar as relações entre a democratização do México e a sua política externa de direitos humanos durante o governo Fox, explorando o impacto da transição democrática na adoção de uma plataforma inédita de política externa que transformou os direitos humanos em um tema central das relações exteriores do país. O argumento defendido é o de que as alterações observadas no comportamento internacional do Estado podem ser explicadas por cálculos endógenos ao próprio governo que com elas buscava ancorar a transição democrática no exterior e sinalizar a credibilidade e seriedade de suas credenciais democráticas.

The aim of this paper is to analyze the links between Mexico's democratization and its human rights foreign policy under the Fox administration, exploring the impact of the democratic transition on the adoption of a new foreign policy platform in which human rights became a central theme in Mexico's foreign affairs. We argue that the observed changes in the Mexican human rights foreign policy were initiated endogenously in the government, which expected to lock in Mexico's new democratic situation with international commitments and to assure international audiences of the credibility of its commitments to democratic reforms and human rights.
