Resumo O objetivo deste artigo é tentar apontar uma possível ligação entre as hostilidades sofridas por Judith Butler no Brasil e uma captura dessas manifestações conservadoras por movimentos políticos. Minha hipótese é a de que um novo populismo pode estar em formação. Nesse sentido, o artigo dialoga com teorias do populismo no Brasil e no atual contexto internacional. O trabalho de Butler serve também como pano de fundo para uma reflexão da política populista e de como os ataques a direitos sexuais e reprodutivos servem de combustível para alimentar forças autoritárias com grande apelo às massas.

Abstract The aim of this paper is to try to point out a possible link between the hostilities suffered by Judith Butler in Brazil and a capture of these conservative demonstrations by political movements. My hypothesis is that a new populism may be in the making. In this sense, the article dialogues with populism theories in Brazil and in the current international context. Butler’s work also serves as a backdrop for a reflection of populist politics and how attacks on sexual and reproductive rights serve as fuel to power authoritarian forces with great appeal to the masses.

Este artigo busca avaliar a criação da Comissão Nacional da Verdade no Brasil e o esforço desta para integrar direitos humanos e meios democráticos de apurar violações passadas. Primeiramente, ele tenta estabelecer uma visão normativa de acordo com a qual a Lei de Anistia de 1979 não é válida porque viola o que Rainer Forst chama de "direito básico à justificação". Além disso, revê e critica à fundamentação normativa das decisões da Corte Interamericana de Direitos Humanos, que recentemente condenou o Estado brasileiro. De acordo com a visão dessa corte, o único modo legítimo que um país tem de apurar violações de direitos humanos é via justiça criminal. Essa perspectiva, o artigo argumenta, é muito estreita e deve incluir também as comissões da verdade.

This paper aims to evaluate the creation of the National Truth Commission in Brazil and its effort to integrate human rights and democratic means to account past violations. First, it tries to establish a normative view according to which the Amnesty Law enacted in 1979 is not valid because it violates what Rainer Forst calls a "basic right to justification". In addition it reviews and challenges the normative foundations of the decisions of the Inter-American Court of Human Rights, which recently condemned the Brazilian state. According to the Court's view, the only legitimate way a country has to make violations of human rights accountable is by means of criminal justice. This perspective, the article argues, is too narrow and must include truth commissions as well.
