Resumo Partindo-se de um campo etnográfico dedicado à realidade da comunidade afro-equatoriana “La Chiquita”, nomeadamente quanto à sua luta pelo território ancestral que é-lhe de direito face à desterritorialização promovida pelo avanço do monocultivo de palma azeiteira, propomos: (I) compreender a dimensão da «colonialidade» do Estado no interior deste conflito, incluindo-se o ethos disciplinar e institucional que interpreta a negritude; e (II) identificar e analisar as diversas formas de resistência desta comunidade em resposta a tal estrutura sociopolítica vertical, trazendo à tona as narrativas do seu contexto desde uma crítica centrada na epistemologia e na sociologia jurídica.

Abstract Departing from an ethnographic fieldwork dedicated to the reality of the afro-ecuadorian community of “La Chiquita”, in particular on its struggle concerning their ancestral territorial integrity in response of a growing dispossession process orchestrated by oil palm monocultures in Ecuador, we propose: (I) comprehend the “coloniality” of the State within this conflict, including the disciplinary and institutional ethos in interpreting blackness; and (II) identify and analyze the various forms of resistance of this community in response to such vertical sociopolitical structure, bringing out their narratives in context from a criticism focused on epistemology and the sociology of law.

Resumo A partir da análise do voto do Ministro Cezar Peluso na ADI nº 3.239, bem como de duas decisões judiciais relacionadas às comunidades de Santana (Rio de Janeiro) e Paiol de Telha (Paraná), o artigo discute o papel da justiça brasileira nas disputas legais por reconhecimento e titulação de territórios quilombolas. Defende-se a existência de uma pluralidade interpretativa do campo judicial acerca do tema, resultado das lutas sociais quilombolas na concretização seus direitos identitários e territoriais.

Abstract Starting by the analysis of the vote of Justice Cezar Peluso in the ADI number 3.239, as well as the two judicial decisions related to the communities of Santana (Rio de Janeiro) and Paiol de Telha (Paraná), the article discusses the Brazilian Justice's role in the legal disputes for recognition and titling of quilombolas territories. It is argued that there are multiple interpretations about this subject in the judicial field, resulting from the quilombolas social struggles in the effectiveness of their identity and territorial rights.
