Resumo O presente trabalho discute os modelos de constitucionalismo não escrito do common law, e suas principais características que instituem novas possibilidades representativas da constituição. Usualmente, cria-se uma distopia divisória do elo entre o escrito com o não escrito, enxergando o texto constitucional como um dogma e uma previsibilidade nas decisões judiciais. Contudo, se os direitos humanos e fundamentais são abertos e abstratos, a mera codificação não restringe seu entendimento. Desse modo, este trabalho busca apresentar novos caminhos interpretativos da constituição, a partir da ênfase nos princípios não escritos, da coerência aos precedentes judiciais, e na possibilidade de uma constituição viva. O método de pesquisa foi funcionalista do direito constitucional comparado. Os resultados alcançados demonstram que a dimensão não escrita do texto constitucional permite definir a constituição como um instrumento vivo, e em constante evolução.

Abstract This paper discusses the models of unwritten or common law constitutionalism and their main features that institute new representative possibilities of the constitution. Usually, a dystopia is created by dividing the link between the written and the unwritten, seeing the constitutional text as a dogma and predictability in judicial decisions. However, if human and fundamental rights are open and abstract, mere codification does not restrict their understanding. This paper intends to present new interpretative paths of the constitution based on the emphasis on unwritten principles, the coherence of precedents, and the possibility of a living constitution. The research method was the functional method of comparative constitutional law. Results indicate that the unwritten dimension of the constitutional text allows for defining the constitution as a living and constantly evolving instrument.

Resumo O presente artigo sugere uma investigação da estratégia neoconservadora que ameaça direitos LGBTQIA+ já conquistados ou que se pretende conquistar. Para tanto, além de investigações comparativas acerca dos conceitos chave deste novo conservadorismo emergente, cujo marco são as descrições propostas por Melinda Cooper e Marina Lacerda, pretende-se uma análise empírica de intervenções selecionadas desses grupos como amici curiae em ações do STF, partindo do método universalista descrito por Mark Tushnet e Ran Hirschl. Tal inquirição é capaz de revelar as estratégias específicas da luta contra o pluralismo e contra a liberdade das pessoas LGBTQIA+, que posicionam a diferença como inimiga e que vocalizam a autoridade moral como caminho para a erradicação do “mal”. Ao fim, a proposta ora avançada se revela uma importante ferramenta para compreensão dos desafios hoje evidentes, buscando que tal consciência revigore a luta pela construção de uma democracia verdadeiramente plural.

Abstract The present article suggests investigating the neoconservative strategy which threatens LGBTQIA+ already conquered or intended to. For the endeavor, beyond the comparative investigation of the new conservatism’s key concepts, based on Melinda Cooper’s and Marina Lacerda’s descriptions, it undertakes an empiric analysis of selected interventions from these groups as amici curiae before the Brazilian Supreme Court, with the outset of the universalist method described by Mark Tushnet and Ran Hirschl. Through the inquiry, it is possible to bring to the fore the specific strategies used to fight against pluralism and individual freedom of LGBTQIA+ people, which position difference as an enemy and vocalize moral authority as a way to eradicate “evil”. In the end, the proposal here fostered reveals itself as an important tool for the comprehension of current challenges, aiming that such conscience can reinvigorate the fight for the construction of a truly pluralistic democracy.

Abstract This article analyzes the convergence of the common law and civil law systems in relation to the parameters of judicial review, particularly when constitutional principles, both explicit and implicit, work to invalidate ordinary laws. The article also uses the Canadian experience to examine how unwritten but implicit constitutional principles can be used for the purposes of judicial review. It also reviews the theory of The Invisible Constitution, by Laurence H. Tribe. Finally, we face the question of the living Constitution, which includes the concept of the Constitution as a living instrument beyond its formal text.

Resumen Este artículo analiza la convergencia entre los sistemas del common law y civil law en relación con los parámetros de la judicial review, particularmente cuando los principios constitucionales, tanto explícitos como implícitos, funcionan para invalidar leyes ordinarias. También el artículo considera la experiencia canadiense para examinar cómo los no escritos pero implícitos principios constitucionales pueden ser usados para el fin de la judicial review. Y de la misma forma se revisa la teoría de The Invisible Constitution, de Laurence Trible. Finalmente, enfrentamos la cuestión de la Constitución viva, la cual incluye el concepto de Constitución como un instrumento vivo más allá de un texto formal.

Resumo Este artigo tematiza o papel do constitucionalismo feminista para a possibilidade da inclusão de uma perspectiva de gênero nas decisões judiciais do Supremo Tribunal Federal (STF). Nesse panorama, o constitucionalismo feminista permite compreender os discursos e os enunciados de gênero que são incorporados nos processos constituintes e nas constituições, resultando tanto na emancipação e no empoderamento jurídico ou em formas de subordinação. Pretende-se responder à seguinte pergunta: no contexto do constitucionalismo feminista, qual o papel do STF na construção e na inserção de uma perspectiva de gênero na jurisprudência brasileira? O objetivo deste trabalho é mapear decisões da Suprema Corte brasileira que desenhem uma prospectiva dessa teoria constitucionalista. O método de pesquisa utilizado foi o dedutivo. Os resultados alcançados indicam que, apesar dos muitos avanços dessa Corte na promoção e na inclusão de uma visão do constitucionalismo feminista na jurisprudência, existem muitos liames jurídicos e culturais que impossibilitam ou retardam o amadurecimento da emancipação e do empoderamento jurídico das mulheres.

Abstract This article thematizes the performance of feminist constitutionalism in the Brazilian Supreme Court, resulting in a gender perspective in the decisions of this Court. In this context, the feminist constitutionalism makes it possible to understand the structure of the discourse of gender, which are embodied in constituent processes and constitutions, resulting in empowerment or subordination of women. It was intended to answer the following question: before the feminist constitutionalism, what is the role of the Brazilian Supreme Court in the construction and insertion of a gender perspective in Brazilian jurisprudence? The objective of this research is to draw decisions of the Brazilian Supreme Court that outline a perspective of this constitutionalist theory. The research method was deductive. The results indicate that despite the Court’s many advances in the promotion and inclusion of a vision of feminist constitutionalism in jurisprudence, there are many legal and cultural ties that preclude or delay the maturation of women’s emancipation and legal empowerment.

O presente artigo analisa a judicialização da política demonstrando que não se trata apenas de um fenômeno brasileiro, mas de algo comum a diversos países ocidentais. Esse movimento tem sofrido severas críticas, que questionam a sua legitimidade e apontam o esvaziamento da esfera política. Em contraponto, é traçado um paralelo com a doutrina da autorrestrição judicial, a qual defende que as questões políticas devem ser enfrentadas pelos poderes eleitos. Por fim, procura-se demonstrar, por meio da análise de decisões do STF e do STJ, como o Poder Judiciário brasileiro tem se manifestado em questões de políticas públicas, de modo a realizar os direitos fundamentais plasmados na Carta de 1988.

This paper aims to analyze the so-called judicialization of politics, showing that it is not just a Brazilian experience, but a common one in several Western countries. This movement has been very criticized concerning its political legitimacy and the exhaustion of political sphere. from the other hand the article analyzes the theory of judicial restraint, which defends that political questions should be decided by elected powers. Finally, it demonstrates through the analysis of Brazilian Supreme Court's (STF) decisions and other Courts decisions such as STJ how Brazilian Judicial Power has faced issues of public policies in order to enforce basic rights present in the Brazilian Constitution of 1988.
