Max Weber e Hans Kelsen são dois autores clássicos considerados de extrema importância na elaboração de alguns dos mais célebres conceitos utilizados nas searas das Ciências Sociais e do Direito, respectivamente. Entretanto, quando se unem tais campos do conhecimento, representados pela Sociologia do Direito, inúmeras confusões terminológicas e relativas ao objeto e ao método de estudo são perpetradas, dificultando que o rigor científico seja atingido com profícua precisão. Nesse sentido, o presente trabalho visa a estabelecer as distinções mais prementes entre a Sociologia Jurídica e a Ciência Jurídica ou Dogmática, tratadas sob a perspectiva da análise dos pensamentos weberianos e kelsenianos.
Max Weber and Hans Kelsen are two classical authors considered extremely important in the creation of some of the essential concepts that are commonly used in the Social Sciencs and Law, respectively. However, when these two fields of knowledge are put together under the rubric of the Sociology of Law, a series of misunderstandings around terminology, objects and methods tend to emerge, making it difficult to attain desired levels of scientific rigor. In this light, the present article aims to establish some of the most important distinctions that need to be made between the Sociology of Law and Jurisprudence, as they are represented by the works of the two above-mentioned theorists.
Max Weber et Hans Kelsen sont deux auteurs classiques considérés comme trés importants dans l'élaboration de certains des plus célèbres concepts utilisés dans le domaine des Sciences Sociales et du Droit. Pourtant, lorsque de tels champs de connaissance se joignent, représentés par la Sociologie du Droit, de nombreuses erreurs terminologiques et relatives à l'objet et à la méthode d'étude surviennent, ce qui empêche que la rigueur scientifique soit atteinte avec précision. Ce travail vise donc établir les distinctions plus urgentes entre la Sociologie Juridique et la Science Juridique ou Dogmatique, traitées sous la perspective de l'analyse des concepts wébériens et kelsiens.
