RÉSUMÉ L’objectif de cet article est de contribuer à la compréhension du phénomène de politisation du pouvoir judiciaire à partir de l’analyse de la figure du juge en tant qu’un agent maximateur de l’utilité. Utilisant des méthodes mixtes quantitatives et qualitatives, l’article a cherché à répondre à la question suivante : Comment la popularité et le prestige générés au cours d’une opération judiciaire contre la corruption politique peuvent-ils influencer la manière dont un juge donné effectuera son travail au Brésil ? Les six cas analysés corroborent les hypothèses de l’étude en révélant que la popularité, le prestige et la possibilité de développer une image positive de soi en tant qu’agent anticorruption sont des variables-clés dans l’analyse du phénomène de politisation du pouvoir judiciaire. RESUMEN El objetivo de este artículo es contribuir a la comprensión del fenómeno de la politización del Poder Judicial a partir del análisis de la figura del juez como un agente maximizador de utilidad. Haciendo uso de métodos mixtos, cuantitativos y cualitativos, el artículo busca responder a la siguiente pregunta: ¿Cómo la popularidad y el prestigio generados en el curso de una operación judicial contra la corrupción política pueden influir la forma por medio de la cual un determinado juez ejecutará su trabajo en Brasil? ABSTRACT The objective of this article is to contribute to the understanding of the phenomenon of the politicization of the judiciary from the analysis of the figure of the judge as a utility-maximizing agent. The study used a combination of quantitative and qualitative methods to address the following question: How can the popularity and prestige generated in the course of a judicial operation against political corruption influence the way in which a particular judge will perform their work in Brazil? The analysis of six cases corroborated the hypotheses of the study by revealing that popularity, prestige and the possibility of developing a positive self-image as an agent in the fight against corruption are key variables in the analysis of the phenomenon of the politicization of the judiciary. In multiparty presidential regimes, the head of the Executive manages a heterogeneous political base through a series of instruments. Among these tools, the use of patronage in appointments for governmental positions and the deployment of pork barrel to please congressional representatives have been highlighted by the literature as the glue that holds together multiparty coalitions. However, current studies neglect the role of politicians as active actors in multiparty presidential regimes in channeling resources to their constituencies and parties when holding a cabinet position. This paper contributes to the literature by merging these two tools of coalition maintenance. We analyze a complimentary strategy that benefits party leaders in the coalition by studying the relation of top-level cabinet appointments and grant transfers to subnational governments. Using data from Brazil, a paradigmatic case of multiparty presidential regime, we intend to answer the following question: Are ministries in Brazil being used to please ministers’ constituency and party allies?
