Abstract The paper aims to analyze how democracy is structured within the neoliberal capitalist system in the Brazilian context. While neoliberalism requires market liberalization, reduction of the social state, and financialization of life, democracy presupposes political and economic equality, public apparatus, and inclusion; thus, it is necessary to discuss this conflicting relationship. The first session of the work discusses the economic, political, and social system of neoliberalism, understanding its requirements and characteristics, as opposed to democratic pretensions, to enter into Brazilian particularities. The second topic analyzes the construction of a neoliberal society in the country, establishing the investigation through the clash between social development and neoliberal advancement in Brazil. Finally, it examines the presence of neoliberal capitalism from the Partido dos Trabalhadores (PT) governments to the first two years of the Bolsonaro government, questioning the place of democracy. For this, the research used the deductive approach method and type of bibliographical and documentary research with a qualitative approach. Resumo O artigo visa analisar de que modo a democracia é estruturada no sistema capitalista neoliberal no contexto brasileiro. Enquanto o neoliberalismo requer liberalização dos mercados, redução do estado social e financeirização da vida, a democracia pressupõe igualdade política e econômica, aparato público e inclusão, desse modo, é necessário discutir sobre essa relação conflituosa. A primeira sessão do trabalho discute o sistema econômico, político e social do neoliberalismo, compreendendo suas exigências e características, contrapostas às pretensões democráticas, a fim de adentrar nas particularidades brasileiras. O segundo tópico analisa a construção da sociedade neoliberal, estabelecendo a investigação por meio do embate entre social-desenvolvimento e avanço neoliberal no Brasil. Abstract This study will analyze the type of political reform proposed by the STF from the identification of the Court’s understanding of the empirical and normative problems of the reformed institutes, its concern with the governability or representativeness of the political system, and whether the proposed changes had the intended effect. Finally, considerations will be made about the relationship between constitutional law, the political system and the theory of constitutional dialogues. The article concludes that the STF’s reformist stance can be illustrated by three phases conditioned by the country’s political situation and driven by different jurisprudential regimes: 1) non-reformist and pro-governability during the period of democratic consolidation (1988-2001), anchored in a positivist hermeneutics; 2) progressive reformist, concerned with political representation during the period of democratic stability (2002-2015) and animated by neoconstitutionalism and 3) dialogical conservatism backed by the thesis of constitutional dialogues ratifying reforms in favor of governability (2016 -). Resumo Esse estudo analisará o tipo de reforma política proposta pelo STF a partir da identificação da compreensão da Corte sobre os problemas empíricos e normativos dos institutos reformados, de sua preocupação com a governabilidade ou representatividade do sistema político e se as mudanças propostas surtiram o efeito intencionado. Por fim, considerações serão tecidas sobre a relação entre o direito constitucional, o sistema político e a teoria dos diálogos constitucionais. Resumo O artigo realiza análise sobre como o conceito de constitucionalismo abusivo vem sendo abordado e aplicado à realidade brasileira. Em seguida, são explicitados os conceitos de crise constitucional e de estresse constitucional para a realização de um diagnóstico a respeito da saúde constitucional do Brasil pós-impeachment. Para o desenvolvimento da pesquisa foi utilizado o método hipotético-dedutivo e quanto ao procedimento, adotamos a investigação bibliográfica de abordagem qualitativa. Como conclusões, destaca-se a insuficiência decorrente da importação de um exame norte-americano para a compreensão da funcionalidade da política constitucional nacional e que as disputas em torno da interpretação constitucional irrompidas a partir do impeachment de 2016 possibilitaram a redefinição da juridicidade constitucional, de forma a corroborar a alteração (não eleitoral) de projetos de governo e ascensão de um candidato da direita populista à Presidência da República e para o agravamento das disputas interpretativas sobre a Constituição.

Abstract The article analyzes how the concept of abusive constitutionalism has been approached and applied to the Brazilian reality. Then, the concepts of constitutional crisis and constitutional stress are explained in order to make a diagnosis regarding the constitutional health of Brazil after impeachment. For the development of the research, the hypothetical-deductive method was used and as for the procedure, we adopted a bibliographic investigation with a qualitative approach. As conclusions, the insufficiency resulting from the importation of a North American exam for the understanding of the functionality of the national constitutional policy is highlighted and that the disputes over the constitutional interpretation erupted from the impeachment of 2016 enabled the redefinition of the constitutional legality, in order to corroborate the (non-electoral) alteration of government projects and the rise of a candidate from the populist right to the Presidency of the Republic and to aggravate the interpretative disputes over the Constitution.
