Resumo Neste artigo, tratamos da Lei n. 12.990/2014, que visa a promover acesso de negros a cargos e empregos públicos na esfera federal estipulando cota de 1/5 das vagas em disputa nos concursos públicos para negros. A exemplo do que ocorre na iniciativa privada, há enorme diferença na quantidade de servidores públicos brancos e negros. Embora o Supremo Tribunal Federal já tenha decidido que a lei de cotas para concursos públicos é constitucional, ela permanece ineficaz e, por consequência, insuficiente como ação afirmativa hábil para promover o combate ao racismo no setor público. Ainda que essa lei determine cota em favor dos negros, dados de concursos realizados na vigência da Lei n. 12.990/90 apontam para sua inefetividade. O racismo estrutural mantém as disparidades entre brancos e negros.

Abstract In this article, we refer to the Law n. 12.990/2014, which promotes access for black people to offices and public employment in the Brazilian Federal Administration by stipulating a quota of 1/5 of vacancies for black people. Likely in the private sector, there is a huge difference between the number of white and black public agents. Although the Federal Supreme Court have decided that the quota law for public contests is constitutional, it remains ineffective and, therefore, insufficient as an affirmative action to support the fight against racism in the public sector. Even though this law determines a quota in favor of black people, data of public contests that took place during the validity of Law n. 12.990/90 point to its ineffectiveness. Structural racism maintains the disparities between whites and blacks.

Resumo Buscamos entender quais são os motivos que continuam a normalizar as práticas racistas no Brasil no século XXI. Identificamos que a desigualdade racial permanece na estrutura social em uma dimensão extraeconômica. A violência estrutural originária do antigo modo de produção escravagista continua intensa, sob a forma de violência cultural, que legitima e naturaliza a reprodução de uma sociedade racista. O capitalismo aproveita o racismo, mas não é a principal fonte dessa discriminação.

Abstract We seek to understand which are the grounds that remain normalizing the racist practices in Brazil in the 21st century. We identify that racial inequality remains in the social structure upon an extraeconomic dimension. The structural violence originary from the ancient slavery mode of production remains intense, in the form of cultural violence, which legitimates and naturalizes the reproduction of a racist society. Capitalism takes advantage of racism, but it is not the primary source of that discrimination.
