Abstract This article has as its theme populism and the low institutionality in Brazil. It seeks to answer the question of why populism in Brazil and the United States led to a degradation of the institutions. The hypothesis is the presence of a contemporary authoritarian personality, which, combined with the electoral and administrative strategies allowed by the institutionality itself, led to a degradation of institutions towards a kind of not only economic, but also social anarcapitalism, which consists of a society without rules. The objective, therefore, will be to clarify how this process of low institutionality took place. The method consisted in the use of a hypothetical-deductive stance, where, in a first moment, the contemporary authoritarian personality was studied, in a second moment the forms of circulation of power and Law and, finally, the consequences in loss of institutionality. Resumo O presente artigo tem como tema o populismo e a institucionalidade legal no Brasil. Ele procura responder a questão do porquê do populismo no Brasil e nos Estados Unidos ter levado a degradação das instituições. A hipótese é que a presença de uma personalidade contemporânea autoritária, essa que, combinada com as estratégias administrativas e eleitorais permitiu a institucionalização em si, levaram a uma degradação das instituições para um tipo não apenas econômico, mas também social anarcocapitalista, o qual consiste em uma sociedade sem regras. Abstract This study aims to analyze the state of the art in the use of Artificial Intelligence (AI) in Brazilian public account control bodies, in all their spheres, whether federal, state or municipal, pointing out the results, costs and costs benefits of these machines. The relevance of this theme is due to the continuous use of this technology by the Brazilian Public Administration and its consequences for the high demands of the Courts of Accounts. The research problem is: What AI mechanisms are being used by the Brazilian Courts of Auditors and if, based on the data released by the Public Administration, it is possible to map the costs and benefits of using such technologies within the Public Administration? In order to answer the problem, it was decided to divide the development into three parts. At first, the idea is to understand the role of the Court of Auditors in controlling public accounts; in a second, to map the use of AI within the scope of the Courts of Accounts, pointing out which activities are used, in addition to reflections on the potential of AI by the control bodies; and, finally, build a table demonstrating the state of the art of AI in Brazilian public account control bodies. The hypothesis is that it is possible to point out a diagnosis based on the research carried out with the Brazilian Courts of Auditors and, still in a preliminary way, it is possible to identify the benefits for the control of the Digital Public Administration. The methodology used is a bibliographic and exploratory study of government documents. The approach is quantitative and qualitative and the research is descriptive based on government documents and scientific articles. It was concluded that AI brought several changes to control bodies, mainly in relation to repetitive demands, that is, it has been a way of enacting irregularities for a more predictive function and less decision-making, at least in part. Resumo Este estudo tem o objetivo de analisar o estado da arte do uso de Inteligência Artificial (IA) nos órgãos de controle de contas públicas brasileiros, em todas as suas esferas, seja federal, estadual ou municipal, apontando os resultados, os custos e os benefícios dessas máquinas. A relevância desse tema se dá pelo contínuo uso dessa tecnologia por parte da Administração Pública Brasileira e em suas consequências para com as altas demandas dos Tribunais de Contas. O problema de pesquisa é: Quais mecanismos de IA estão sendo utilizados pelos Tribunais de Contas brasileiros e se, a partir dos dados divulgados pela Administração Pública, é possível mapear os custos e benefícios do uso de tais tecnologias no âmbito da Administração Pública? Visando responder o problema, optou-se por dividir o desenvolvimento em três partes. No primeiro momento, a ideia é compreender o papel do Tribunal de Contas no controle das contas públicas; em um segundo, mapear o uso de IA no âmbito dos Tribunais de Contas, apontando quais atividades são utilizadas, além de reflexões sobre as potencialidades da AI pelos órgãos de controle; e, por fim, construir uma tabela demonstrativa do estado da arte da IA nos órgãos de controle de contas públicas brasileiros. A hipótese é de que é possível apontar um diagnóstico a partir da pesquisa feita junto aos Tribunais de Contas Brasileiros e, ainda de maneira preliminar, é possível identificar os benefícios para o controle da Administração Pública Digital. Resumo Investiga-se a capacidade institucional das cortes de contas, como formadoras e aplicadoras de precedentes e súmulas, para responder: é possível uma aproximação profícua com o regime de padrões decisórios do Código de Processo Civil-CPC, assim como um diálogo produtivo com a Lei de Introdução às Normas de Direito Brasileiro-LINDB? O objetivo do trabalho é analisar, a partir das capacidades institucionais abstrata e concreta dos tribunais de contas, a aptidão para formação e aplicação de padrões decisórios. Para tanto, elegeu-se a teoria interpretativista de Ronald Dworkin, especialmente porque acredita-se que os precedentes se entrelaçam em uma trama discursiva, na qual cada intérprete se coloca no compromisso de analisar as decisões passadas, de forma reflexiva, para decidir no presente e, ao mesmo tempo, antecipando também os sentidos para o futuro da decisão, que se faz no aqui e agora. A hipótese é de que os tribunais de contas têm aptidão potencial para formar e aplicar precedentes e súmulas, decorrente do exercício de suas competências constitucionais. Observou-se, que o desenvolvimento da capacidade institucional concreta, para formar e aplicar padrões decisórios controladores, permite uma melhor compreensão da relação entre as decisões dos tribunais de contas e as judiciais. Trata-se de trabalho teórico, de análise jurídica do tema, valendo-se do método dedutivo, partindo-se de uma análise geral para se chegar à capacidade institucional dos tribunais de contas para formação e aplicação de padrões decisórios.

Abstract The institutional capacity of the courts of audit as makers and applicants of precedents and summulas (restatement of case law) is investigated to answer the following: is it possible a mutually beneficial approach to the decision standards regimen from the Civil Procedure Code-CPC, as well as a productive dialogue with the Law of Introduction to the Brazilian Legal Statutes (Lei de Introdução às normas do Direito Brasileiro-LINDB)?. The objective of the work is to analyze, from the abstract and concrete institutional capacities of the audit courts, the aptitude for the formation and application of decision-making standards. To do so, Ronald Dworkin’s interpretive theory was chosen, especially because it is believed that precedents are intertwined in a discursive plot, when every single interpreter commits to analyzing past decisions, in a reflexive way, to decide in the present and, at the same time, anticipating the directions for the future of the decision, which is made in the here and now. The hypothesis is that the audit courts have the potential ability to form and apply precedents and summulas, arising from the exercise of their constitutional powers, but that it is also necessary to develop a concrete capacity to form and apply controlling decision patterns. In this way, it allows for a better understanding of the relationship between the decisions of the audit courts and the judicial ones. It is a theoretical work, of legal analysis of the subject, using the deductive method, starting from a general analysis to reach the institutional capacity of audit courts for the formation and application of decision-making standards.

Assim, o problema que move este artigo se coloca: diante dos elementos de exceção e de neoliberalismo, pode-se dizer que o controle social da Administração Pública já se constitui uma mera ideia vazia de significado? A hipótese é a de que sim, é possível falar em decadência do controle social, principalmente por meio de um de seus principais mecanismos, o acesso à informação. O método de trabalho é o hipotético-dedutivo, testando-se a hipótese a partir da argumentação desenvolvida.

Abstract The present work deals with an investigation of the relations between neoliberalism, the State of Exception and social control in contemporary Brazil. Thus, the problem that moves this article arises: in the face of elements of exception and neoliberalism, can it be said that social control is already a myth, a mere empty idea of meaning? The hypothesis is that yes, it is already possible to talk about the decay of social control, mainly through one of its main mechanisms, access to information. The working method is the hypothetical deductive, testing the hypothesis based on the arguments developed.

Resumo O problema que move este trabalho envolve a especulação sobre como a jurisprudência do STF sobre impeachment de Presidente da República impacta no regime jurídico do impeachment de prefeito. A hipótese é a de que os mesmos argumentos e causas de decidir do impeachment de Presidente se aplicam aos prefeitos, em uma abordagem a partir da Democracia Deliberativa e dos Discursos, contudo, tais perspectivas são altamente criticáveis. Em um primeiro momento será abordada a relação entre Democracia Deliberativa e responsabilização de prefeitos; em um segundo, a para, em seguida, demarcar, de modo especulativo, os princípios do regime jurídico dos crimes de responsabilidade; em um terceiro momento analisar-se-ão os argumentos que justificam o caráter jurídico-político da decisão de impeachment para, finalmente, criticar-se um certo ativismo judicial que se materializa justamente pela inanição do Poder Judiciário em cuidar das condições do processo democrático.

Abstract This work problem´s develops around the speculation of how the Supreme Court jurisprudence on President’s impeachment impacts the legal framework for the impeachment of the Mayor. The hypothesis is that the same arguments and reasons to decide the impeachment of President apply to mayors. In an approach from the Deliberative Democracy and Discourses, however, such perspectives are highly objectionable. At first it will be addressed the relationship between Deliberative Democracy and accountability of mayors; in second, demarcate, in a speculative manner, the principles of the responsibility crimes; In a third step will analyze the arguments justifying the legal and political nature of the impeachment decision to finally criticize a certain judicial activism that materializes precisely the starvation of the judiciary in taking care of the conditions of the democratic process.

Resumo O presente estudo tem por objetivo principal construir uma inter-relação com as problemáticas geradas por uma democracia “não-amadurecida” em relação aos possíveis entraves existentes para a efetividade do controle social no Brasil contemporâneo. Para tanto, buscará enfrentar e debater ao longo da história contemporânea o que pode ser considerado como uma democracia “não-amadurecida”, perpassando assim pelas problemáticas do Estado Moderno, o qual pressupõem principalmente uma mobilização política da sociedade. Também, buscar-se-á abordar temas latentes como a necessidade da formação de uma sociedade civil com tradição de organização e consciência do seu papel em um Estado Democrático. A par disto, investiga-se a efetivação ou não de uma democracia substancial e não apenas formal e as suas respectivas implicações no que tange a busca pela libertação do cidadão enquanto cidadão de um Estado Democrático. Ou seja: quais os ônus suportados pela sociedade na qual as arenas de debate e reflexão são timidamente proporcionadas ou quase não efetivadas, buscando-se, portanto, romper-se com o modelo de Estado burocrata e decisor que predominou na formação do modelo de administração da coisa pública no Brasil.

Abstract This study’s main objective is to build an inter-relationship with the problems generated by a developing democracy against the possible existing obstacles to the effectiveness of social control in Contemporary Brazil. So, seek to confront and debate throughout contemporary history which can not be considered as a developed democracy, permeating in the problems of the Modern State, which presuppose a political mobilization of society. Also, seeks to address underlying issues such as the need for formation of a civil society organization with tradition and awareness of their role in a Democratic State. From this, the work investigates the effectiveness or not of a substantial democracy and not only formal and its implications regarding the search for the liberation of the citizen as a citizen of a Democratic State. That is: which are the burdens borne by the society in which the arenas of debate and reflection are tentatively offered or hardly effected, seeking to break up with bureaucrats and state decision-making model that prevailed in the formation of the management model of res public in Brazil.
